“Kagan and Obama have contempt for the constitution and founders.”

This will be a good test to see if the Republicans have learned anything. My guess is no.

She was the Dean of Harvard Law School right?

So she was responsible for teaching lawyers. Any guess as to what they were taught? Who put in her in that position? Any guess as to their agenda?

“And yet she was Dean of Harvard Law School... “

Normally you can’t be a professor without a long list of publishing. Seems like this was in the plan for a while.

First Amendment speech should be weighed against "societal costs.”

I heard this argument in the campaign finance debate. Liberals believe that "powerless" individual don't have "free speech" in comparison to "powerful" interests. Therefore, they claim, a "differing power group" should be permitted to be their "powerful friend" and give them "real" free speech by shutting down the free speech of "other power groups." Translation: liberals know better so we should be able to shut down the free speech of anyone who disagrees with us.

Kagan is extremely dangerous. Senate republicans should block her to the best of their ability until the rules are changed. At that point in time, there will be future methods to fire her from the bench.

This entire process, though, is more evidence that the old concept of independent judiciary is no longer applicable and should be scrapped by constitutional amendment. A federal justice should have a 9 year term and then only be continued on reappointment by president and reconfirmation by Senate. Eventually, there would be a possible transition of one scotus justice per year.

“In a 1996 paper, “Private Speech, Public Purpose: The Role of Governmental Motive in First Amendment Doctrine,” Kagan argued it may be proper to suppress speech because it is offensive to society or to the government.”

Some "conservative.". This is to the left of the ACLU.

This belief automatically disqualifies her.

I honestly don’t know what she would do for a living, if it weren’t for academia(these days more like academentia).

These people are kooky! No one will ever take your first amendment rights away. In fact, I think we have more cause you can go out and scream the f-bomb on the highway or have orgies!

This is America! that means its FREE! you can choose which beer to drink and which sports team to watch. You still have choices about which government-approved car to drive!

If you think we could ever lose our freedoms because of what the supreme court does, you’re crazy and you hate America first!

(Yes, I have heard/seen people make these arguments. Not all, but most, of them were made here on FreeREpublic.)

“Whether a given category of speech enjoys First Amendment protection depends upon a categorical balancing of the value of the speech against its societal costs.”

>>Obama’s new litmus test is hatred of Free Speech.

The 1st amendment has always been detested by Apparatchik elite-wannabes - Especially by Eunuchs who were inbred for service within Royal hierarchies.

Observe the sexually dysfunctional “Leaders” among the vestigial religious remains of the (un)Holy Roman Empire, for example...
