Jolly Rancher Lands Fort Bend County Third-Grader in Detention for a Week
KHOU ^ | May 6, 2010 | Gabe Gutierrez

Posted on 05/08/2010 1:18:07 PM PDT by nickcarraway

A third-grader at Brazos Elementary was given a week’s detention for possessing a Jolly Rancher.

School officials in western Fort Bend County are defending the seemingly harsh sentence. The school’s principal and superintendent said they were simply complying with a state law that limits junk food in schools.

But the girl’s parents say it’s a huge overreaction. “I think it’s stupid to give a kid a week’s worth of detention for a piece of candy,” said Amber Brazda, the girl’s mother. "The whole thing was just ridiculous to me."

Leighann Adair, 10, was eating lunch Monday when a teacher confiscated the candy. Her parents said she was in tears when she arrived home later that afternoon and handed them the detention notice.

According to the disciplinary referral, she would be separated from other students during lunch and recess through Friday.

Jack Ellis, the superintendent for Brazos Independent School District, declined an on-camera interview. But he said the school was abiding by a state guideline that banned “minimal nutrition” foods.

“Whether or not I agree with the guidelines, we have to follow the rules,” he said.

The state, however, gives each school discretion over how to enforce the policy. Ellis said school officials had decided a stricter punishment was necessary after lesser penalties failed to serve as a deterrent.

Ellis said failing to adhere to the state’s guidelines could put federal funding in jeopardy.

According to the Texas Department of Agriculture’s website, “The Texas Public School Nutrition Policy (TPSNP) explicitly states that it does not restrict what foods or beverages parents may provide for their own children's consumption.”

Not to mention the fact that the mother not being married has nothing to do with this situation! Maybe she is; maybe she’s not. I can’t understand some people’s need to find something to pick apart and judge people, do you? It’s irritating why some posters do this! The mom may have broken up and remarried, and the child kept her own last name?

Here’s the thing... That ‘law’ was passed in order to get rid of vending machines on campuses ~ in high schools and middle schools mostly, but it affects all schools.

This is a case of an administration run amok. There is absolutely no comparison between a Jolly Rancher and a bag of chips.

Oh come on, now that makes me mad! I sent my kids to public school, because I was single and did not have the luxury to stay home and home-school or have the money for private school. I went to public school at least until 4th grade. My parents loved me and my sister and brother, they were definitely not abusive! Why must you and some other people paint others with a tar-brush?

I loved my kids to pieces, they knew it, and I was never abusive! In fact, I’m afraid I was a little bit of a pushover. So keep your judgments to yourself! They still had/have some decent teachers and some decent public schools in the country, you know!

I wish I could’ve been able to home school, or send them to private school, but I couldn’t. I had to work to take care of them. Because if I didn’t, or if I was on welfare, someone would’ve been putting me down for being on welfare, and being a leech on the taxpayers! So what else are people supposed to do in that situation?

I’m not calling the parents who send their children to school the abusers. I am calling the Leftist teachers the abusers. The schools you and I might have attended 20 to 30 years ago are not quite like what they are today. Many parents are still in the dark as to the agenda of what the Leftists are doing within our educational establishment. Enough are smelling the hot coffee that they are pulling their children out of government school or not letting go at all and are choosing other alternatives like home schooling as well as private and parochial.

I have no doubt you love your children unconditionally. Even though you might not be able to afford to home school or another alternative you can still teach your children to think independently and critically as well as excel past what other children their age are doing. You have to be vigilant about the kinds of things being taught in the class room, analyze the text books they are using, and ask your children what is going on in class.

If you leave the education of your child to the schools they attend your children are going to miss out on more they could have learned.

If I had to eat for nutrition i’d commit suicide!

Maybe so, and maybe I was a bit upset. I may have misunderstood. Peace?
I think the reason I get uptight, is that I’ve come across a group of people on here lately that insinuate that if you/someone sends their child(ren) to a public school, then they don’t love them, or they are committing child abuse! Now you may not have meant it that way, but the way you worded that previous post,(in all due respect)did strike me that way. At least that’s the way I took it! Thank you for explaining it!

Yeah it’s quite true that many schools are not what they used to be, sadly. Still, there are many in some more conservative areas-our state (UT for example)- that are still pretty good about their teaching. That said, we do have our share of left-wing fruit-loops like other states.

It could be the presence of the LDS church. In addition to that, we have a number of other churches present, and they work closely together and with the LDS. Maybe we’re all nervous, and we stick together in spite of doctrinal differences!

What if mom packs a kids lunch and puts in a pudding cup for dessert? I can’t believe this crap! A JOLLY RANCHER? You’d think she brought a gun to school.

BTW I think a week of detention for one jolly rancher candy is pretty absurd.

It's totally absurd. The system used to work when teachers could discipline disruptive students (i.e. bullies, not Jolly Rancher eaters), principals could discipline (i.e. fire them without a parachute) poorly performing teachers, superintendents could discipline bad principals, and parents could fire unresponsive superintendents (i.e. superintendents who put teachers ahead of parents).

Fire public schools

Sorry about the wording. There are many parents who don’t care about the education of their child and place their trust solely in the hands of the Leftist-infiltrated and dominated educators who are having a field day using them for their own purposes. I am sure close to 100 percent of FReepers care very deeply about their children’s education and have taken their own initiative to make sure it’s better than what government is providing.

About five percent (and growing) of children are now home schooled and it really is irking the NEA and the state level teachers unions as well because it is taking money out of their pockets.

If we are to turn this country around back to God and prosperity we have to take charge of our children’s eduction both from a moral/ethically perspective and a secular way.

I know kids who have a different last names from their parents because the father died and their mother remarried.
