Article I Section 9 Clause 2:
The privilege of the writ of habeas corpus shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it.
First, we would have to call foreign terrorist cells in the United States an "invasion" or "rebellion." Then we can suspend habeas corpus.

I’d argue that public safety aspect of it is the operative clause. Back in 1787 they had no clue about terrorists and car bombs and the like. Invasion and rebellion were the two methods of safety being in jeopardy. But that category has obviously expanded.
Okay...I guess I need to read my copy of the Constitution and the Bill of Rights a bit more.
Thing is...IF that is the way to get the job done...WHO would be willing to call those terrorist cells an ‘invasion’?
