He can’t. The Legislature is not in session.

There are those things called special sessions. Perry can call a special session for a single topic, but won't and shouldn't do so if it's not a time-critical issue. He's called special sessions in the past.

I disagree that this rises to the level of necessity for a special session (particularly since Perry has already sent lawyers to fight Obamacare), plus remember the antics of the Dems the last few times around. There’s an election coming up and many of them will be losing their positions, so then will be time to deal with it.

I’m not a huge Perry fan, but there isn’t much he can really do under Texas law.
