Still no verdict from the jury in the trial of David Kernell who is accused of hacking into Sarah Palin's email account. It's only been two days, but still one would think that this is an open and shut case.
I just want this punk to get a felony conviction record, some time in jail (not 50 years) a lengthy community service sentence - say working for a Palin charity (laughing).
And watch him do the perp walk out of the courtroom.
I think they have to decide who they dis’ more- the defendant or the prosecuting attorneys.
If convicted, the maximum possible penalty is 50 years in prison.
That's a pretty idiotic sentence for the charges.
I'll give him 30 days in jail, 15 days picking up trash on the highway in an "I'm an idiot" sandwich board, and two years probation.
[ ... just thought it sounded interesting ... :-) ... ]
The kid has shown no remorse. Promised to cooperate with the FBI and appears to have renigged.
He obviously is guilty of breaking into her e-mail account with intent to harm her campaign. (get the goods on her) It had to be to try and help his precious Obozo.
He said horrible things about Palin in exchanges while he compromised her e-mail account.
Don’t trials come in 2 phases? Guilty or innocense and then penalty phase. Surely the system allows for judgement of what an appropriate sentence is.
Likely a dem holdout.
We’re talking a Knoxville, TN jury(liberal college town/capital city of TN); not to worry, the libs are just trying to come up with a way to exonerate him. After all, he is the offspring of a ‘rat politician.
Give him the 50 years and be done with it. Let him try to get it shortened later.
They must have not excluded all the leftists from the jury.
Palin haters on the jury?
I wouldn't - the jury's charge is to determine guilt. If he is found guilty there are all sorts of deals, appeals, etc. If he is found innocent, he is free as bird (which he will no doubt flip to the prosecutors, judge and Palin) and will go through life thinking actions have no consequences. America doesn't need another narcissitic, arrogant lberal - there are already enough in the West Wing alone!
Was there any exculpatory evidence? Any reasonable defense? Sounds like the defense managed to get a liberal "the ends justify the means" Palin hater on the jury.
Palin is GUILTY....for being a CONSERVATIVE!! This creep will be found NOT GUILTY...it’s the times we live in, Black is white, up is down, good is bad.
He is charged with hacking into the personal e-mail account of Sarah Palin, fraud, unlawful electronic transmission of material outside Tennessee and attempts to conceal records to impede an FBI investigation.
—
1. hacking into the personal e-mail account (he did that)
2. fraud (might be hard to prove)
3. unlawful electronic transmission of material outside Tennessee (no question he did this)
4. attempts to conceal records to impede an FBI investigation (no question he did this)
Nashville is the capitol of TN, not Knoxville.
I wouldn't - the jury's charge is to determine guilt.
Well, in this case, I would convict the guy too...
BUT, aside from this guy, I will say that the jury's job is also to prevent unjust laws from being carried out on citizens, and "Jury Nullifiction" is also within the rights of a jury to carry out.
I know that Judges and DA's and other authorities don't like this -- but this is a good conservative protection for this country and its people...
As I said, I'm not talking about this guy, but I'm talking about the duty of the jury in cases where there are unjust laws and "Jury Nullification" comes into play. That's a duty of the jury, too.
I knew that, had to be one of those ‘villes.
However, as you point out, it's not really an issue in this case.
