This Oficer has had some bad advice. The Military court will never force Obama to produce any documents calling them irrelevant to the charges. He will be found guilty and his career goes down the drain. I don’t know who was/is advising him, but he will have done all this and accomplished nothing. Damn shame.
Under discovery....Lakin can subpeona the real long-form BC of Obama. A military judge would not want to have a case overturned on appeal because he refused to allow discovery.
And, if the prosecution or judge fights the subpeona of the real Obama BC....you know full well that Obama is not qualified to serve as CIC. And, if the prosecution really has a slam-dunk case...they are not going to waste time challenging a defense subpeona for Obama’s real BC
A court-martial is more along the lines of a civilian criminal proceeding....the only difference is that there not need to be an unanimous jury verdict to convict. The rules of evidence are very much along the lines of the Federal court system
To exactly whom does Obama’s eligibility make one iota of legal difference, either inside or outside the military?
All I hear any of the lawyers saying is that the president is irrelevant to everybody. He doesn’t make a dang stinking difference to ANYBODY, legally speaking. Nobody answers to him and nobody’s life is impacted in particular by him. It doesn’t matter one bit to anything or anybody whether he even exists, much less whether he is a forging, perjuring, bribing sabotager sent from the enemy.
How can this be so?
How can it be that the ONLY people to whom Obama is at all accountable are the very people he places second in command behind himself? We have it set up so that the ONLY people who could possibly even QUESTION Obama’s authority are the people whose very position depends on Obama having authority. How can we possibly imagine that this fits the Founder’s vision of separation of powers, checks and balances, accountability to the law, and the ability of the people to hold their government accountable?
It’s a travesty. I spit on the whole process, if it really is as all the lawyers say it is.
Unless, of course, he's not Prez, according to that Constitution that you all took an oath to support and defend.
I'm betting that Col. Lakin will never see the inside of a court room. Obama simply cannot afford to allow someone to have the power of discovery on this issue. Ain't gonna happen.
I predicted that it would be the Democrats calling for Obama's Birth Certificate by Spring of this year. They seem to have a political death wish. Many will have their wish granted this year. The Democrat inner-tribal blood-letting will start election night this year. During winter of next year, a few Democrats will start calling for the President's Birth Certificate as part of their "I was duped" Defense.
Joe Farah's been hosting the Liddy Show, he reported that Arizona passed a law requiring candidates to document their eligibility. Farah predicted that Obama would not run again, because he can't document his eligibility for office.
The Democrats are going to suffer, due to all of the Obama/Pelosi/Reid radicalism. Slogan: There are no moderate Democrats.
Can Obama still be the CIC if he’s sitting in jail for forgery, perjury, charity fraud, and extortion? Can he ever have been the real CIC if all the crimes he committed were in order to get illegally elected in the first place?

The focus on the birth certificate and where Obama was born obscures the overarching significance of the face that he is not a natural born citizen. Proof that he was born in Hawaii will not affect his status.
That is my question also. I thought this was the heart of the issue. All this about where he was born seems to be a misdirection. Isn’t the fact his father was not an American Citizen all that is required?? What is the answer that is used to refute THIS issue??

I think this has the best odds of happening....because Lakin will have the Obama BC subpeonaed for discovery. It would be hard to challenge discovery....and any challenge of the Obama BC being released pretty much seals the proof that Obama was not born here.
So...watch the military...after many delays....drop the C-M of Lakin

So many Freepers and conservative pundits fall in line and keep the focus on the non issue of the birth certificate. The only thing that matters is whether Obama is constitutionally qualified to be president. Everyone knows that Obama’s father was not a US citizen. That excludes Obamas eligibility. The MSM wants hide this simple fact.
People need to stop being willing accomplices in that misdirection.
If he was born in Hawaii then the age of his mother is irrelevant. One can argue if he's natural born or not, but not his citizenship status of some sort. He's a U.S. citizen.
He can ask that it be subpoenaed but that doesn't mean the judge has to allow it.
Unless the certified electronic document proves to be a fraud.
