NEW YORK A federal appeals court on Wednesday handed the government a victory by temporarily blocking a judge's finding that Congress was wrong to halt federal funding to the activist group ACORN.
The 2nd U.S. Circuit Court of Appeals in Manhattan also agreed to expedite the government's appeal of U.S. District Judge Nina Gershon's rulings that the funding cutoff was unconstitutional. Oral arguments were likely to occur before July.
The appeals court's one-paragraph decision to freeze Gershon's two rulings that found Congress acted unconstitutionally will remain in place until the 2nd Circuit rules on the merits of the government's appeal. It acted a day after hearing arguments.

It is an AP story so it is pure propaganda designed to confuse. ACORN is being reconstituted under another name. Another Obama shell game.
If Congress wants to “investigate” something, I’d like to recommend that they “investigate” Gershon.
What are the names ACORN is using ?
Too bad this court didn’t rule that Congress’ funding of all NGOs is illegal.
Judicial activism will kill us yet. There is nothing in the Constitution that expressly forbids the government from stopping funding. I would bet that the judge who said that had no problem with Congress cutting off funding for operations in South Vietnam in, what? 73 or 74, leading to the U.S. withdrawal and the fall of Saigon and the communist takeover of a country.

Remember how smug she was last year when she said they didn’t rely on government money - all the money they needed came from members of ACORN!!!!! Never could figure out what kind of zombies would join an organization like that - much less pay dues....

U.S. Court of Appeals Suspends Ruling that Congressional Funding Ban on ACORN was Unconstitutional
WASHINGTON D.C. Today, U.S. Rep. Darrell Issa (R-CA) Ranking Member of the Committee on Oversight and Government Reform and Judiciary Committee Member released the following statement on the U.S. Court of Appeals Second Circuit decision to stay the December 2009 injunction by Clinton-appointed Judge Nina Gershon that the Congressional funding ban on the Association of Community Organizers for Reform Now (ACORN) was unconstitutional. As a result, as the U.S. Court of Appeals further reviews the case, the Congressional funding ban will go back into effect, and ACORN will not receive taxpayer dollars.
I applaud the Court of Appeals for immediately addressing the effects of Judge Gershons attempt to legislate from the bench. Todays action immediately restores the congressionally mandated ban on funding ACORN and its affiliates as a result of their criminal conduct and wasting of taxpayer dollars. Congress has the constitutional right to deny an organization the benefit of taxpayer dollars.
With todays action by the Appeals Court, the Obama Administration must take immediate steps to re-implement the funding ban for ACORN Congress put in to law. In recent months, ACORN has undergone a rebranding campaign to disguise itself and its affiliates. As a result, the White House and all federal agencies must be extremely vigilant to ensure that rebranded organizations who have continued to make deals and maintain connections to ACORN dont receive taxpayer dollars.
