Bill Clinton: Appoint Non-Judge to High Court
Wall Street Journal ^ | April 18, 2010 | Laura Meckler

Former President Bill Clinton urged President Barack Obama to consider appointing someone to the Supreme Court who comes from political life, but said both he and his wife, the secretary of state, were too old for the job.

Several senators have also urged the White House to look at candidates outside the judiciary to replace retiring Justice John Paul Stevens. Political figures used to be well represented on the high court, but all nine justices serving now came from the federal appeals bench. Nominees from such a background are seen as easier to confirm and as more predictable once they get there.

“I hope he’ll take a look at somebody who hasn’t been a judge,” Clinton said on ABC’s “This Week.” “Some of the best justices in the Supreme Court in history have been non-judges, people that — as [former justice] Hugo Black once famously said, had been sheriffs and county judges, people that have seen how the lofty decisions of the Supreme Court affect the ordinary lives of Americans.”

Obama’s list of contenders includes a few non-judges. Elena Kagan, the solicitor general and former dean of Harvard Law School, is seen as a top possibility. Other non-judges on the list include Michigan Gov. Jennifer Granholm and Homeland Security Secretary Janet Napolitano, a former Arizona governor

I once oversaw a project to “convert” a company's paperwork that had been lawyered to the max back into English. Took 400 pages of pure gooblygook and turned it into 300 pages of policies etc, that a regular person could understand and it had the same legal content.

Right now I am working with a company where purchase orders are 22 pages of lawyer BS. many vendors will not od business with them because it is such garbage. I call it “comprehensible translation”.

This is Clinton trying to give Obama a nice-sounding idea that’s yet another way to insert a touchy-feely liberal leftist into the court. In principle, it’s a brilliant ploy: how can one attack a “lay-person”? Certainly there’s no court record for a non-jurist. The GOP would be reluctant (more than usual) to go after such a person for fear of the backlash... even if there’s a record of speeches and political activity that would belie the intent of such a nominee.

It’s going to be Kagan. There is NO question. The lengths Obama went to try and suppress her lesbianism proved it.

“A non-lawyer simply cannot do the job.”

I don’t think Clinton was arguing for a non-lawyer. He was arguing for a non-judge. The most famous examples of Justices who were not previously judges did happen to be lawyers, including Hugo Black, William Douglas and Earl Warren.

I can’t vouch for the veracity of this, but allegedly every single SC justice has been a lawyer in one form or another.

“I hope he’ll take a look at somebody who hasn’t been a judge,”

Nice try, Bill, using reverse psychology to get Obama to consider appointing you or Hillary. It was an especially clever needle to act as if your “old age” were a barrier to serving given that 4 of the 8 remaining justices already exceed you in age—some by quite a bit (Ginsburg 77, Scalia 74, Kennedy 73 Breyer 71). SURELY you weren’t suggesting these geezers lacked the energy possessed by “doers” to carry out their responsibilities!
