Re-posting this in light of the Dems wanting to perp-walk CAT, Deere, AT&T and the like. They need to arm themselves with this.

BTW, mods you can flame me for reposting this, but I think in this fight all the ammo that can be put in the arsenal needs to see the light of day by as many as possible. JMHO!

I support you 100%. I posted links to Ken C (VA AG) and Bill McCollum (FL AG) plus Levin’s Landmark Foundation.

We need to also send it to the Doctors Association in NJ that filed suit in Fed Court in Newark.

Keep posting it. A lot better then some defending McCain, semi-satire garbage and defeatism.

1.) The commerce clause deals with the regulation of commerce. How can the gov’t regulate commerce if someone doesn’t engage in commerce?

Here we have a situation where the government prohibits
interstate commerce in insurance in the first place which
makes it even more confused.

It dawned on me yesterday at a rally to support our AG who has joined the suit against the US government over healthcare -

If women have the right to control their reproductive lives (read that: their health), why don't I have the right to control my health? Seems a major disconnect.

There are people here who run Live groups for Rush, Savage, Beck, Levin, Hannity and others - can they get this to the shows? Drudge would be great too.

Kill the Bill and fast track it to SCOTUS!

A lot of Docs are waiting to see how this plays out over the next 2-3 months before they decide to quit or not. Docs are hard-wired to make changes in the summer - med school graduation and start internship July 1, start residency July 1, to service July 1, etc, so I suspect a lot of them will plan to retire around July 1st if Obamacare looks like it's going to continue. I hope the Bill is dead by then. . .

I don’t see how this will be a “significant problem” for the bums currently in charge. They have two options:

— fund the mandates. What’$ a few more billion, anyway?

or

— repeal Clinton’s legislation. “Unfunded Mandates Reform Act” sounds so 90s. Totally passe. This is the era of arugula and boob belts. Let the states eat cake.

Thanks for this post. Good ole Billy! Sadly, I kinda miss his type of Dem in the House. I couldn’t stand him, and though we never saw his medical records, we knew who he was! This unfunny Kenyan is kinda scary!

How many states are going to have to deal with unfunded mandates that far exceed $50 million dollars and into the tens of billions of dollars each year and pertain to a host of services that will have to be funded by the federal gov't under ObamaCare?

Sadly the Unfunded Mandate Reform act of 95 won’t stop anything in obamacare.
If I read the mandate correctly ti says that IF new legislation causes a state more than 50 Million a year then Congress would require CBO to score it and then Congress must explain why it is important.
this from a WaPo David Broder piece in 2005
“Basically, it was no more than a requirement that committees of Congress, when writing a bill that would impose new duties on states, local governments or private companies, obtain an estimate of the additional costs they would entail and make those part of their report on the legislation.

Under the newly approved procedure, any mandate that would cost state or local governments more than $50 million a year, or private business $100 million, would be subject to a point of order during debate — and legislators would have to vote specifically that the benefit was worth the cost.”

really a toothless waste of voting.

How disappointing but if we keep trying we will stop this
