The courts would be the first step.

US Conference of Catholic Bishops, National Right to Life and Family Research Council have all come out with statements saying that an Executive Order would not override the statute and, thus, does not solve the problem for pro-life Democrats.

This whole maneuver by Pelosi and Obambi shows THEY DON'T HAVE THE VOTES. And, now with all these Catholic organizations coming out against the Executive Order, they're not likely to get them. On that news, I think I can go to bed and sleep tonight.

If he can do it with an EO, WTF does he need Congress for?

I think it's more like grasping at straws.

Maybe they think they can fool Stupak. Maybe they watched too much West Wing.

FRC is nondenominational, but since they speak for some powerful evangelical groups they are not to be scorned.

Executive Orders (EO’s) are generally used to direct federal agencies and officials in their execution of congressionally established laws or policies. Under Article 2/Section 3 which directs the President to “take Care that the Laws be faithfully executed.”

EO’s allow the President to make law without the consent of Congress, which is a power the Constitution does not grant him. [Much like the Courts legislating from the bench.]

EO’s historically have not been checked, or reversed, by Congress, thus they are the Law of the Land. [Congress truly provides no oversight, of themselves or the Executive with their lack or review or sunset provisions]

Issuing them, like legislating from the bench, can and does violate the separation of powers and the ‘checks and balances’ the Constitution envisions.

EO’s are misused by politicians who have theirown agenda to make reality. The abuse by EO’s is a threat to the liberty that our Founding Fathers fought for to win independence.

EO’s do have a worthwhile purpose, if and when correctly applied.

If not for the abortion funding, many, if not all of the Stupak bloc would probably be eager to vote for this bill. I think they are true believers. There are others who are interested in political cover, but I don’t know if the Stupak group is among them.

It’s a risk trusting The One and an EO. IF they do vote yes based on the EO and it is found out later they were clearly warned beforehand that the EO would not hold up, THEN they will face serious reprisals from their constituents. That would prove all they wanted was political cover.

To challenge in the courts, you must have standing, how does one have standing when challenging the President of the US. Especially when those that would challenge and have standing are dead and in a dumpster at the back door of an abortion clinic?

Why didn’t he just encourage Pelosi to accept the Stupak amendment? Because he can rescind an EO that’s why.
