Yeah right, like she is going to do that.

I'm not sure she has a choice. A lawyer called Rush today and said 20% could demand a recorded vote. Mark Levin called in and said it had to be a bill that was in front of the House but this is, right?

1/5th of the members present or 44 members if a bare minimum quorum is there in the House can demand a recorded vote under the Constitution but it doesn’t have to be a roll call vote (That’s why they ask members requesting a recorded vote to rise and remain standing). The House has used electronic voting for decades to publish the yeas and nays on the journal. An actual calling of the roll is only subject to the discretion of the chair.

I faxed a letter to Boehner's office and Ryan's offices on Thursday with the same concept but couldn't get through to Rush's show. I'm glad a lawyer concurs and had the time to get through. The reference is Article I, Section 5, third paragraph.

I believe the Constitution supersedes the Speaker of the House, and Pelosi's refusal to honor the request of the 20%+ for a roll call vote by name can and should cause an immediate Constitutional crisis.
