Napolitano: Deeming Obamacare passed "unlawful" but courts will not intercede
Fox News Channel | 3/17/10

The Judge on using the Slaughter Rule... the courts (including SCOTUS) will refuse to get involved, ruling that the bill can be changed only through additional congressional votes... Levin is wasting his time... bummer, man...

Guess there are NO Patriots left.

I’m still holding out hope, that someone with power will rise up.

I don’t think we’ll get the same story from Levin.

Giving the changes this law would cause and given the mood of the country, I think I am going to disagree.

Levin is not wasting his time. He can get a fund to fight this bigger than both presidential campaigns combined.

So is “Incompetano” threatening Judges?? Saying they will be harrassed or investigated to keep them from taking up the case........That’s messed up but to be expected from a rat..

I'm not sure, but I think I heard him say yesterday that a suit can not be brought until someone with standing has been affected by it...until someone refuses to pay the tax or fee, etc. Deemocrats must be held liable for this travesty.

How Deemocrats vote...

Don’t public officials lose their immunity when they act outside their sphere of responsibility? Seems to me that’s exactly what these A.H.s are doing.

Somehow the courts can dictate spending, like ACORN, bit not whether this monster is Constitutional??

Really? One branch of the government can violate the Constitution and another branch can’t check it? Well, heck, this Constitution is meaningless then. So why doesn’t the president just write up what he wants, and we’ll call that law. Like Rush said, it’s time to start deeming our taxes paid.

“Somehow the courts can dictate spending, like ACORN, bit not whether this monster is Constitutional??”

Well, yeah. Sort of like they have been for the past 40 years. The Courts, like Congress, the bureaucracy, the news media, the entertainment complex, the “social activists,” academia, and sadly but increasingly, organized religion, are all part and parcel of the same leftward march to state control over the individual.

This “standing” crap is just that... pick the right court and their house of cards will fall. SCOTUS will smash it when it gets there.

So Incompitno’s position is: “Sure, we’re breaking the law; but it’s okay because it’s US doing it, not that evil BUSH administration!”

Napolitano is not as smart as he may seem. This end run around the constitution is nothing short of an attack on the whole institution of government and is as much an attack on Congress itself as it is on the Constitution. If they can do this with a big piece of legislation like this, then the whole idea of representative government is rendered moot. The speaker of the house would become a defacto dictator. I for one will not stand idly by while our entire system of represenative government is destroyed.

They may be able to get the bill signed into law, but whether or not the Supreme Court will enforce it in light of a Constitutional Challenge is a horse of a different color.

If this gets passed the only recourse for the American people is to violate the law with impunity. This would be legitimate moral and legal grounds under the Declaration of Independence for a rebellion. I would hope that the Supreme Court would take that into consideration before taking a pass on hearing the issue.

I thought we had a representative system to keep extremism out of the government.
