SAN DIEGO A 30-year-old sex offender was charged Wednesday with murdering a 17-year-old San Diego County girl in a case that could end in the death penalty.
Prosecutors say John Albert Gardner III also faces a special allegation of rape or attempted rape involving the teen, Chelsea King, who vanished last week after heading off for a run in a park. Police say a body found Tuesday in a shallow grave is likely that of King.
Gardner also was charged with assault with intent to commit rape in an unrelated Dec. 27 incident.
An attorney entered pleas of not guilty on Gardner's behalf during his brief court appearance Wednesday.
The district attorney has the option to pursue the death penalty, but that determination has not been made yet.

Anyone who molests a child deserves the death penalty.
I agree with you. But, in a 5-4 decision called Kennedy v. Louisiana (2008), the Supreme Court found it unconstitutional.
There is a school of thought in the law enforcement community that says if you make it policy to hang someone for raping a child, it makes them (the offender) that much more likely to murder the child. This isn't why it was found unconstitutional, but it is probably something to think about.
Yep. A lot of folks here also wondering if he had anything to do with Amber DuBois' disappearance back in February '09. For those not in the know, DuBois was another San Diego-area teen who vanished without a trace while jogging.
I teach self defense to young woman, and the very first thing I teach before a single defense maneuver is demonstrated is to minimize the chance of a attack by not being vulnerable.
The very first example I use is to never jog alone. Especially the same route day in day out, as a predator will set his sick clock to yours.
The fatigue of jogging it self makes you more vulnerable than a average attack situation.
And before the half reader reactionaries start at me, I’m in no way blaming this beautiful young girl for her fate. CLEAR?

He sexually assaulted and beat a 13 year old after luring her to his house 10 years ago. He only spent 5 years in prison, instead of life and was on the street to kill Chelsea because of it.

This is just a moronic notion. A very pretty girl goes running alone with no apparent protection in a place that offers a lot of concealment. She should have felt un-safe and taken appropriate precautions. Run with friends, bring pepper spray, run with a big mean dog, anything. The world is a dangerous place, always has been. I'm not blaming her, but adults should be warning kids about life's dangers, not thinking that they can run around without a care in the world.

AGREED, but after all, it IS California. Look for a plea deal to escape the death penalty. If by some odd chance, this SCUM does get the DP, look for 30 years of appeals while he makes a mockery of the system, culminating in a week worth of “candlelight vigils” by idiots who “treasure life” and call for “compassion.”
I have seen some sick things in my life but the thought of the last few minutes of this girls life makes me ill.
