Ginsburg.

McCain doesn’t object to liberals, he is one.

She gets a wider reading audience this way. There’s more money in hating on McCain, than hating on Obama.

Perhaps three. There's a decent chance that both Stevens (who's a lock for retirement) and Ginsburg will retire this summer. That will allow Obama to appoint three very young and orthodox liberal judges to the Supreme Court. Obama will be gone, but his judicial appoints will continue to hear cases for the better part of the next 30 years. Everyone always forgets that.

How do you know McCain would not have nominated another Souter? Hard to predict, but McCain did vote to approve Ginsberg. And, he orchestrated the Gang of Fourteen to eliminate the nuclear option on judicial nominees.

Do you honestly believe McCain would have appointed staunch conservatives? I don't. I believe he would have been all too ready to appease the left with moderate or left-of-moderate appointees.

But the second argument about the impotence of the Senate Republicans is worth some discussion, too. The fact is that this Gang of 14 moderates, led by Senator John McCain, did make it much more difficult for the president to win an ideological battle over a Supreme Court nominee. The Democrats did, in fact, send warnings that they were prepared to filibuster the second nominee. And under such circumstances, the president would have needed 60 votes to confirm his candidate, not 51.
