The judicial keelhauling of New York's Bravest continues apace.
Federal Judge Nicholas Garaufis -- without a shred of evidence that the FDNY had discriminated against minority applicants -- last week imposed strict racial hiring quotas on the department.
For every five new hires, Garaufis ordered, the department must reserve two spots for black applicants and one for Hispanic applicants -- until precisely 293 minority firefighters have been hired.
He also ruled that fully 7,400 minority applicants who took the FDNY entrance exam in 1999 and 2002 could claim monetary damages from the city.
It's a ruling as absurd as it is offensive.
Absurd -- because, despite Garaufis' pinpoint precision in judging exactly the ratios needed to satisfy the purported demands of racial justice, his evidence for actual discrimination doesn't exist.
Indeed, he ruled that merely because the test used in '99 and '02 -- which no one has demonstrated is anything but totally job-related -- didn't produce the desired racial outcome, FDNY brass must have been intentionally biased against minorities.
That's nonsense on stilts: The FDNY didn't become the best metropolitan firefighting force in the world by focusing on anything but whether applicants could do the job.
On the other hand, injecting considerations other than competence into hiring decisions is the first step down a dangerous path.
Besides, few things are more offensive to American notions of fairness and equity than strict racial quotas.
To be sure, there are probably a number of things the FDNY can do to boost the minority presence in its ranks.
But on this ruling, a vigorous appeal -- to the Supreme Court, if necessary -- is more than appropriate.
Basic fairness demands it.

quota’s are unconstitutional, the supreme court will slap this clown down, no need to worry.
It won’t take long. The supreme Court has ruled that quotas are illegal.
The judge’s ruling is evidence that he believes blacks and Hispanics are not as intelligent as whites. Institutional racism like this should be stomped out.
He would not be impressed.

I am a fireman and I can tell you that I will not go into a burning building with anyone that just barely passes the Firefighter coutse but is promoted because of race.

A few weeks ago I read that the Chicago PD was considering eliminating their entrance exam because...
...my first reaction is disbelief...then a slow sadness sets in...is this the way the country is headed?...is it only going to get worse?....how did it happen that minorities get to go to the head of the line?...regardless of their performance.
Doesn’t this already violate a SCOTUS ruling, at least in college admissions? Why wouldn’t it also cover hiring?

We’re in the Twilight Zone folks! The FDNY now has to hire minorities who didn’t to as good as the whites and Asians on the test. Why not hire midgets, 100 lb. women, disabled folks, drug addicts, and parolees? I mean let’s be politically correct.
I’m sure it is going straight up the ladder (no pun intended). Too much recent case law to slap it down without prejudice (dang, I did it again!)
I think we should put quotas on SCHOOLS...they have to hire a certain percentage of CONSERVATIVES!

This is ridiculous. This just screams to minorities that the government believes that they are substandard and can’t compete on their own.
In an attempt to create fake equality, it creates real animosity.
