2) if captured alive, Mirandize on the battlefield, bring to US thereby granting US Constitutional protections, place in US Penal system with 3 squares & a prayer rug to indoctrinate other prisoners, place on lengthy, well-publicized & expensive federal trial to risk dismissal of all charges

Not only that.

As I understand it, the law prohibits “assassination.” So we can’t use black ops personnel to go cut somebody’s throat, killing only him.

Instead we have to use a bomb and by definition generally kill and injure innocents in the process.
