Obama's Treaty-Making Powers Broader Than Recognized

It's Possible for Both Houses of Congress to Ratify a Treaty by Majority Vote

Though arguably the most powerful man on the planet, U.S. President Barack Obama heads to Copenhagen later this month wearing handcuffs. The failure of Congress to pass domestic climate legislation has meant the president has had to advance slowly, lest he get ahead of lawmakers in the Capitol. After all according to the Constitution, international treaties must be ratified by 67 "yes" votes in the Senate.

Also still fresh in everybody's mind is the 95-0 vote the Senate cast in opposition to US participation in the Kyoto Protocol, though that vote happened more than a decade ago...

Well here it is. Lord Monkton referred to this in his speech in Copenhagen today. This is the blueprint by which they intend to enact a COP15 Treaty outside of the normal Consitutional 2/3 Senate ratification. They have thought long and hard about this.

What's the odds that he can hold the filibuster-proof majority to pull off this stunt?

I tried to warn people about the use of treaties it was about Second Amendment rights on a thread regarding the CIFTA treaty and everyone said no way!

But, is there a glimmer of hope that some dim senator can be prevailed upon to see this as an encroachment on their turf? “Sheets” Byrd maybe?

He’s sleeping some where but not in the Capitol.

I don’t know if any others would rein Obama or any President in for that matter.

It’s always a game of I do what I want when I’m in ... you do what you want and reverse me when you’re in.

Agreed, but how about taking the "bigger they come, the harder they fall approach"?.

i.e., pulling a stunt like this on such a contentious issue, particularly in the light of the CRU scandal, and on a piece of legislation that goes far deeper than any trade pact, sets Zer0 up for a massive fail if so much as one senator can be encouraged to protect the constitution/parliamentary traditions?

Or am I just being naive?

I’m watching this one very closely. I am also getting my passport renewed, so I can get out quickly if I have to. I’m not going to let the Zer0 put me in shackles, literal or legislative. I’ll ride out the storm elsewhere, and come back when the time for renewal is at hand. At this point, my only obstacle is a family-law matter, or I would have left already.

...use of treaties...

Two things. One, The president cannot ratify treaties. Only Congress can do that. Two, We The People MUST go to the voting booth and rejectthe scum that currently holds public office, and implant people who will repeal all of this crap.

Thomas Jefferson maintained that there is always a third option since governance can only occur by the consent of the governed.

“Ala Clinton .... Executive Order time.”

You’re the only one who got it right.

In 1994, the senate rejected the UN’s Biodiversity Treaty. Clinton said “Screw that” and ordered the fascist bureaucrats to implement the treaty anyway. And they did, illegally. The jellyfish republicans did nothing about it and left property owners to fend for themselves. The whole damn illegal action was out there for anyone to see, including clinton’s signatures on ALL the damn illegal executive orders

The fascist clinton shouldn’t have been impeached for the blue dress but for his illegal executive orders to implement the biodiversity treaty. Americans would have understood that.

Damn republicans are useless. Trent Lott should be indicted as an accessory to treason.

We need an American-style Nuremberg tribunal to rid this country of fascists, on both sides.

Parts of the Kyoto treaty were also divided up into several Executive Orders.

“Parts of the Kyoto treaty were also divided up into several Executive Orders.”

I’m not familiar with that, but breaking up the treaty into bits and pieces - to be implemented by the federal fascist bureaucracy - would follow the treasonous clinton model.

And not a word was said by Congress ... cause he was a Dem.

Let Reagan or Bush try it. Or worse have Congress pass a law (Patriot Act) and shouts of unconstitutional and such are heard to the heavens.

Let a Dem pas an act, say Universal Healthcare, and only little peeps are heard.
