Justice Depart. subpoenaed in New Black Panthers case--Panel cites lack of cooperation

The U.S. Commission on Civil Rights, frustrated by the Justice Department's failure to explain the dismissal of charges against New Black Panther Party members who disrupted a Philadelphia polling place during last year's elections, has subpoenaed the department demanding records showing how the case was handled.

David P. Blackwood, the commission's general counsel, said Tuesday in a letter to the Justice Department that efforts since June to obtain an explanation had proceeded "without any success" and the "dearth of cooperation" had prompted the commission to issue subpoenas.

"We are both mindful of the sensitivity of the subject matter involved and aware that, in response to similar requests, the department has raised various concerns and matters of privilege," Mr. Blackwood said. "While such considerations carry weight, cooperation with commission investigations is a mandatory statutory obligation.

"Moreover, due to the unique investigative role of the commission - akin to that of a congressional committee - disclosure to the commission of the information sought is both proper and required," he added.

The commission has asked the department why a civil complaint against the New Black Panther Party (NBPP) and three of its members was dismissed after a federal judge in Philadelphia ordered default judgments in the case. The NBPP refused to respond to the charges or appear in court.

The department's Voting Rights Section was in the final stages of seeking the judgments when Loretta King, who was serving as acting assistant attorney general, ordered a delay.

Someone needs to remind Holder of matters of law. Equity should not be overlooked. Out of fairness and equity, the New KKK (who ever they are and wherever they are... I doubt they even exist) should be granted the same opportunities to escape scrutiny. Therefore, they need to get a gratis get outta jail free card as well.

“Fairness” is not just for people aligned with the president.

I’m surprised the CCR is so persistent on this being Holder is involved, it may go nowhere but not for the lack of trying.

Yep, it’s pathetic when the DOJ has to be subpoenaed for the law to be enforced. Holder is a superb yes man for Zer0 and Zero’s string puller.

I guess it's all coincidence for that name to appear on the logs, and it would also be a coincidence if the date of the visit was just before the charges were dropped.

Sorry, no sale.

ALL of these animals do exactly what Ubama and the rats tell them to do. This is nothing more than a charade, like when the ACLU defends Illinois Nazis. "See? We're non-partisan!" Additionally, it provides the Commission cover for future mischief when they actually do mean business.

This thing here will go nowhere.

You may well be right, that’s a real possibility. The thing that’s strange is the CCR going through this subpoenae process when they didn’t have to. We’ll know soon if it is a charade.

IIRC the CCR is still run by a majority of Bush era appointees. This was the group that had that Barry woman trying to stop the seating of a republican appointee.

Thanks, that would explain it. This thing with the CCR isn’t something new, they’ve wanted answers from DOJ from the time the charges were dropped which has been months. It looks to me like they mean it.

They have 6 year terms so after 8 years of Bush that means at least 4 at one point were his. The other 4 are appointed by speaker of house, and head of senate which, due to 6 year terms may also have been appointed by republicans.
