A critic of the U.S. military policy is suing the federal government because a letter that she wrote to her serviceman son stationed in Iraq was returned with "DECEASED" errantly stamped on it in red letters.
The lawsuit filed last month in Minneapolis federal court by Joan Najbar, of Duluth, claims that "as a result of receiving the letter indicating that her son was dead, Ms. Najbar suffered emotional distress with physical manifestations."
Najbar, whose son Sam Eininger was serving with the National Guard when the letter was returned in 2006, is seeking relief from damages including emotional distress, loss of income, attorneys fees and other expenses and "additional damages to be proven at trial."
A claim Najbar filed in 2008 with the U.S. Postal Service sought $118,000 in damages. That claim was twice denied. A letter from the Postal Service said its investigation found no negligence.

You’d think she would be so grateful it was a mistake. I am sure there are families of soldiers who would give up their life savings to hear that the report their children were dead was wrong.
I feel for her.
They should compensate her and her son with an extra week’s liberty.
No money. But an extra week with your son in a case like that would be worth gold.

I am with the soldier’s mother on this one. Military families have enough to worry about with the current Commander in Chief.
The post office made a major mistake, and they need an incentive to keep this from happening again.

Yep....like johniegrad, I know her too. Every year on Veteran’s Day, she writes a military protest letter to the editor of the Daily A$$wipe.....I mean the Duluth Tribune. The positive part of this is the online comments attached to the story.....out of 45 I read this morning, 42 of them essentially called her a gold digger and told her to get a life. Her poor son must be in hiding from embarassment.
