Pretending to be a naïve tax preparation customer, Christina [Talarczyk, an ACORN activist in San Antonio] walked into a Jackson Hewitt office with a Dateline producer who had a camera hidden in his sunglasses. The tax-preparation employees were caught on camera as they tried to convince Christina to take out a high-interest RAL [Refund Anticipation Loan]

Was there fraud involved or just pushy sales talk?
Do you know that you can get a lower rate at a gym if you negotiate a better price? Same with buying a car, a home, getting a loan, or even buying a mattress.

So, are they trying to put tax preparers out of business so that everyone will have to use ACORN as their tax preparers?

Different states, different laws. In California (where ACORN was recorded), it is illegal to record a confidential conversation unless all parties consent to recording. In Texas (where this incident apparently occurred), only 1 party must consent to the recording. Not defending ACORN here, just explaining the legal distinction that would prevent ACORN from being charged with illegal recording in this case.

They were trying to up-sale a customer.

A RAL is a product. The consumer can buy the product or say no.
It's not like the preparers were trying to sell prostitution and harboring illegals. Or trying to convince the ACORN boob to cheat on her taxes.

I knew that the Texas provision applied to phone calls, but not to “in person” conversations. There are laws against recording performers without their consent in Texas.

It's only a scandal in the eyes of NBC and ACORN obviously. If people want the money bad enough they will accept the legal loan. Of course, if those loans weren't available and ACORN and/or NBC thought they should be they would probably be trying to tape someone refusing to give them one. Damned if you do, damned if you don't when it comes to these scums.

Talarczyk said she paid a $300 fee last year to get instant access to her $5,100 tax refund. Talarczyk, who at the time couldn’t afford her own apartment and was living with relatives, thought the fee was for the preparation of the taxes.
She was unaware she actually was taking out a loan (what a freaking lie!). The interest rate on the loan her tax preparer was offering: about 55 percent.
Talarczyk got off cheap, said Rep. Mike Villarreal, D-San Antonio. Companies...
