Not a lawyer, but since the Mother now resides in VA with her daughter, does the Judge even have jurisdiction? Can he enforce his writ down in VA?
Also, the woman in Vermont wasn't even going to sue for custody until the gay and lesbian groups got in touch with her and convinced her to do so. What kills me is that this woman doesn't even care for the girl, she's just doing it so the gay/lesbian groups can force the issue into the courts and get their activist judges to create a new precedent.
But like the article says, the lawyer for the woman in Virginia will appeal the decision and they still have the Virginia courts to go through, and if necessary, it will go to the Supreme Court.
The Virginia appellate have decided that the Vermont decision must be given “full faith and credit” in Virginia, despite Virginia’s marriage amendment which supposedly protects Virginians from recognizing other state’s fake marriages. This is a horrendous travesty. Something will have to give.
The child would have had to be in VA for six months pre-lawsuit in order for VA to have jurisdiction under the Uniform Child Custody Jurisdiction Act.
