He was going under 33 mph because the airbags didn’t deploy. Hard to imagine getting “seriously” injured in a large SUV going under 33 and running into a stationary object. Something doesn’t add up here.

Not really. When he slammed into the tree, the car came to a sudden stop and his head lurched back and then forward hitting the steering wheel or dashboard.
