Prosecuting American 'War Crimes': The ICC claims jurisdiction over U.S. soldiers in Afghanistan

Secretary of State Hillary Clinton expressed "great regret" in August that the U.S. is not a signatory to the International Criminal Court (ICC). This has fueled speculation that the Obama administration may reverse another Bush policy and sign up for what could lead to the trial of Americans for war crimes in The Hague.

The ICC's chief prosecutor, though, has no intention of waiting for Washington to submit to the court's authority. Luis Moreno Ocampo says he already has jurisdiction—at least with respect to Afghanistan.

Because Kabul in 2003 ratified the Rome Statute—the ICC's founding treaty—all soldiers on Afghan territory, even those from nontreaty countries, fall under the ICC's oversight, Mr. Ocampo told me. And the chief prosecutor says he is already conducting a "preliminary examination" into whether NATO troops, including American soldiers, fighting the Taliban may have to be put in the dock.

"We have to check if crimes against humanity, war crimes or genocide have been committed in Afghanistan," Mr. Ocampo told me. "There are serious allegations against the Taliban and al Qaeda and serious allegations about warlords, even against some who are connected with members of the government." Taking up his inquiry of Allied soldiers, he added, "there are different reports about problems with bombings and there are also allegations about torture."

It was clear who the targets of these particular inquiries are but the chief prosecutor shied away from spelling it out.(continued)

If Obama allows this happen even once, or signs the treaty, it is high treason and he must be quickly removed from office.

Turning over American soldiers over to a foreign entity to be tried is a bright red line, which must not be crossed.

American soldiers are not faceless Hessians. They are our sons and daughters. They are last years high school senior class. Any attempt to ship an american soldier to the ICC must be resisted in any way that is effective. Rescuing and hiding the soldier away, is *utterly moral* in that circumstance until Obama can be voted out.

If indeed Barry is apart of this or in any way, shape, or form in agreement with this: Will Barry likewise be held accountable for those civilain deaths related to his approval of the use of drones to attack targets?

The ICC can literally kiss my arse, if I was POTUS.

Am I the only one who believes Holder with Obama’s support would allow our military to be tried in a military tribunal and sentenced to death for following orders but would allow any member of the Taliban or Al Quada to be brought to the US and tried in an American court room with full constitutional protections?

It is so critical that Obama be stopped cold in the 2010 election with a congress he cannot get ANYTHING through. First he must be stopped, then voted out. The best thing for our nation would be a crushing defeat for him at the hands of voters, so he is always remembered as a Jimmy Carter.

Another reason why I believe we MUST bring all US troops home NOW.

Fight no wars when the CIC is a member of the enemy camp!

No matter how bad the consequences of our cutting and running... nothing is worse than having our soldiers being led by a member of the ENEMY.

Bring them all home.

NOW.

The fact that Mr. Ocampo mentioned the Sudanese perpetrator of genocide in the same breath with alleged crimes of NATO soldiers shed light on what the International Criminal Court may have in store for the U.S. in the future.

The US should never give any international body jurisdiction over anything that happens in the US, or anything done by US military personnel in foreign nations. This is just one more battle line between those who value US sovereignty and the America haters who want to weaken us.

No accident that Slick signed agreements that put us on the road to signing up to the ICC, and no accident that Hillary expressed "great regret" that we didn't sign on in the past.

I expect Obama will sign on if he thinks he can get away with it without too much political damage.
