US Marine not guilty of prostitute rape

A US sailor cleared of raping a prostitute in a Sydney brothel is "looking forward" to returning to California.

While Petty Officer Timothy Davis had admitted using a "lock down manoeuvre" to pin the woman to the bed, he denied forcing himself on her, saying he had only wanted his money back.

The 25-year-old had pleaded not guilty to having sexual intercourse without consent, aggravated by causing the woman actual bodily harm.

He also denied an alternative charge that, with intent to have sexual intercourse, he recklessly inflicted actual bodily harm on her.

After a week-long trial, a jury in the NSW District Court found him not guilty of both charges.

He left the court complex without speaking to reporters, but his lawyer, Sam Macedone, said Petty Officer Davis was "very happy" with the verdicts.

"He is glad it's over," Mr Macedone said.

"It has been very stressful for him.

"He is looking forward to going back to San Diego."

Yes, I know there are significant problems with the reporting in this story showing the normal difficulties the media has getting basic facts about armed forces right. By all means point them out, but please remember, I didn't do it.

(like most sensible sailors, I avoid making basic errors regarding United States Marines...)

When drunken sailors want their money back from a bad prostitute, we know the economy is hurting.

(OK, so we don’t know he was drunken.)

Rape in a whorehouse may be an old joke, but there is very little doubt in my mind that this sailor’s behavior came very close to it.

I don’t think he is out of the woods, either. As I recall, the brothels are off limits to US Military personnel, regardless of whether they are legal, so he is up for a violation of a direct order and possibly other charges resulting from this.

I hope he is charged and I hope he is discharged. This man has no business wearing the uniform.

Let him pick up B-girls or streetwalkers; or order out through an "escort service", like everybody else has to!

Not a fan of whorehouses... but if the US Military had your standards regarding behavior of personnel I think they would have a difficult time maintaining troop levels.

I am not upset that he got his ashed hauled.

That would been hypocritical of me in the extreme considering my own service in the Navy back in my younger years. What I am upset about is they way he treated the woman and that his behavior does, to me at least, come very close to rape — even if it occurred in a whorehouse.

If he had been a decent customer and had not used violence against the woman, there would not be a story here. He did. He admits his conduct was outrageous. Further, his conduct is going to reflect badly on every other servicemember.

You’re a fine freeper but at first i thought you might be off on this one but after reading the whole article I see you were quite right.

I’ve never forced myself on a woman either like that...whore or saint.

Won’t happen (and shouldn’t). Nonjudicial (captain’s mast) at the most, probably not even that... A reduction in rank would be severe.

It isn't right but it isn't rape either. Luckily he seems to have come to his senses at the last minute.

But after she started shouting `Stop!" and "Help!" he had realised what he was doing was wrong, and had later told police he thought his behaviour was "outrageous".

Also, luckily, it sounds like he had the sense to admit what he had done even though it doesn't do him much credit - not try and brazen it out.

He deserves to pay for what he did. But not for what he didn't.

I just want to add to this bit I just said - because as somebody who teaches boys/young men, it maybe reflects something I all learn.

When you screw up. When you've done the wrong thing. Tell the truth. Own up to your mistakes. It makes it a lot easier for people to help you and a lot more likely to want to.

he entered her and wailed away for half a minute ( an eternity for a guy half my age..lol) or so without a rubber on while he held her down and closed her mouth with his hand after she had asked him and pleaded with him not to do her without protection

and he looks pretty good sized.....if not rape it’s mighty damned close

a whore has a right to ask for a rubber to be used and to not be abused

and yes...I have been around..a lot..a long time ago

5 kids..2 of whom are nearly grown women.

His reason for wanting his money back was he could not perform with a condom on and wanted to have sex “like a real man”?

I’d said that six years in the pokee is what he needs, of course he isn’t out of the woods yet, The Navy can still try him under the UCMJ.

I suppose Australia did not think to have robbery and assault and battery be included in the possible charges. He apparently could not even bring himself to obey the rules of that house of ill repute. Why should he get away with this any further than with bullying conduct in a different kind of business establishment?

Nonsense.... The same crap goes on in Okinawa all the time..

Okinawian Japanese who have a political agenda against Americans make crap up all the time to try and stick it to American GIs to embarass the US.. Goes on everywhere.

Since the Hildebeast and her Canckle Queen Posse began passing laws making crimminals out of GIs who visit brothels overseas selected Prostitutes and Organizations have tried to use the GIs unwillingness to draw attention to themselves as a means to extort money or cheat American GIs of agreed upon services..

You and I have no idea what the reality of this particular situation is on the ground but we can be sure there are forces trying to exploit the situtation for their political benifit...
