Accused 9/11 mastermind Khalid Sheik Mohammed and four others must be, and will be, convicted, Attorney General Eric Holder said Wednesday in defense of his controversial recent decision to try the five alleged terrorists in a federal court in Manhattan.

In a hearing attended by some families of 9/11 victims, Holder found himself on the hot seat, pressed with critical questions by Republicans, though backed by Democrats.

"I believe this decision is dangerous. I believe it's misguided. I believe it is unnecessary," said Sen. Jeff Sessions of Alabama, the panel's ranking Republican. "The correct way to try him is by military tribunal."

Holder is an incompetent buffoon. It’s transparent that staging this publicity stunt in NYC is an effort to portray Obama as tough on terrorism/crime to bolster his failing reputation among large swaths of the public. Rather than doing his job as Attorney General he is running errands for the White House.

This administration is staffed by willful, arrogant, and rather stupid children. All Holder proved today is that he is an Affirmative Action AssKlown, like the man who actually made this incredibly stupid decision, the Anointed One of Allah, BHO, Jr. Graham took him apart. The MSM covers it by only running Holder's cocky bullshiite.

Holder will, of course, have to fall on his sword to protect Raila Odinga's pal and my putative POTUS.

What are these people really doing? This cannot be it.

If here is a real attorney on this site who has any idea what the constitutional law is on this subject, I would like to ask the following:

Judge Napolitano says that under the Constitution, it is illegal to try the terrorists in a military court unless the US has declared war, which we have not done.

The judge is highly respected, so I ask one more question.

If the terrorists are never allowed to set foot on American soil, would that not make it legal to try them in a military court?

If so, then we are making a huge mistake in speaking of closing Gitmo and bringing them to the US.

In 1942, the Supreme Court took up the case of Ex Parte Quirin, which pondered whether President Franklin Roosevelt—our most left-wing president until now—could lawfully and constitutionally order that a group of Nazi saboteurs captured on U.S. soil be tried by military commissions.

The unanimous justices pointed to Article 1, Section 8, Clause 10, and noted that Congress in 1806 had passed a law that “imposed the death penalty on alien spies ‘according to the law and the usage of nations, by sentence of a general court martial.’” This 1806 law, they observed, was based on a prior law enacted by the Continental Congress on Aug. 21, 1776 -- hardly a month after approval of the Declaration of Independence.
