Accused 9/11 mastermind Khalid Sheik Mohammed and four others must be, and will be, convicted, Attorney General Eric Holder said Wednesday in defense of his controversial recent decision to try the five alleged terrorists in a federal court in Manhattan.

It’s transparent that staging this publicity stunt in NYC is an effort to portray Obama as tough on terrorism/crime to bolster his failing reputation among large swaths of the public. Judge Napolitano says that under the Constitution, it is illegal to try the terrorists in a military court unless the US has declared war, which we have not done.
The judge is highly respected, so I ask one more question.
If the terrorists are never allowed to set foot on American soil, would that not make it legal to try them in a military court?
If so, then we are making a huge mistake in speaking of closing Gitmo and bringing them to the US.

This 1806 law, they observed, was based on a prior law enacted by the Continental Congress on Aug. 21, 1776 -- hardly a month after approval of the Declaration of Independence.
