It's one thing for you or I to say that he's an enemy combatant ... quite another for The Congress to say so.
I'd say that he's an enemy combatant ... and that he was wearing our uniform while engaged in direct action against us. That makes him a spy, IIRC ... seems to me The Army can just put him up against a wall and shoot him.
