I will reserve the full answer to that question until I see whether KSM is charged with a capital crime or not. If he is, I suspect he would be begging for military justice since the people of New York are very likely to treat sentence him to death.

What does Obama do if the jury doesn't convict either KSM, or one of the others? And, let's not forget that no other country is going to take them back. And, even if they did, KSM's defense team would easily be able to fight extradition on the grounds that he might be tortured in whatever country would have him back. Is some federal judge going to order his release? Or, is he going to be stuck in some kind of legal limbo in perpetuity. And if so, where?
This is a mess and I only hope that Obama comes to regret it without the death of additional Americans.

I’m sure once some idiot fed judge dismiss the case and releases them they will be quickly hunted down and taken care of.
Fox news is reporting that they are asking for the death penalty for the head goat fornicator, and four others are to be tried for the same crime(s).
By the time a typically limp wristed federal judge gets done $hitcanning all of the prosecution’s evidence the head goat fornicator will probably get a summary judgement for dismissal with prejudice, and walk out of the door. That’s probably what his control, the great zero, and holder are hoping for. If he’s convicted, I’m pretty sure there will be no death penalty, and in the unlikely event there is, it’ll take 20 years to get around to it.
