FORT HOOD, Texas The attorney for the Army psychiatrist accused of killing fellow soldiers at Fort Hood says doctors have told the soldier he may be paralyzed from the waist down. Attorney John Galligan told The Associated Press on Friday that Maj. Nidal Malik Hasan told him that he has no feeling in his legs and doctors say the condition may be permanent. Galligan says Hasan also told him he had extreme pain in his hands. Hasan was shot by police officers responding to last week's shootings at Fort Hood. Galligan spoke with him Thursday in the intensive care unit at Brooke Army Medical Center in San Antonio. Hasan has been charged with 13 counts of premeditated murder in the attack at the sprawling Texas post that also left 29 people wounded. THIS IS A BREAKING NEWS UPDATE. He will NEVER be executed, and I think this ‘paralyzed’ ploy is a ruse to make sure it never happens. His case will
be protracted indefinitely, for a whole host of reasons owing to the ‘special interests’ of ‘both sides’ of this ‘issue’.AND this brand-new story of Kalid Sheikh Mohammed being taken out of Gitmo and given a CIVILIAN trial in New York City, as proposed by the AG, is going to
be USED as an interesting counterweight, counterbalance, and test balloon to the long-way-off Hasan trial, however and whenever it’s done.

Trial clock is normally set at 120 days, except that can be delayed by defense-requested delays such as for further investigation, expert assistance, mental status evaluations, etc. We have had cases hanging around for eight months or more depending on the complexity of the issues and the pre-existing docket calendars of civilian defense counsel. However, you are correct in that, barring defense-requested delays, the accused has to be arraigned within 120 days of referral to trial by by the Convening Authority.
The minimum jury required for a general court-martial is five officer members. Now, of course, because of challenges for cause and peremptory challenges during the seating of the panel, between 10 and 12 are always initially detailed to the case, with alternates standing by. Each side is allowed any number of challenges for cause (although such challenges do not have to be granted by the military judge, they usually are) and, normally, one peremptory challenge; that is, a challenge against a member for no reason at all. Such peremptory challenge is automatic; the member is dismissed from the panel. The only exception to the peremptory challenge is that, upon such challenge by the government counsel, the prosecution must be able to state a racially- and gender-neutral rationale for such a challenge (and, in this case, it will probably include a religion-neutral exception as well). In the end, though, the Manual for Courts-Martial and the UCMJ requires only that there be five members remaining after all challenges have been exhausted.
In this case, knowing J.P. Galligan personally as I do .. having been involved in courts-martial both when he was a military judge and as a civilian defense counsel .. I believe that we can count on many many pretrial sessions with defense motoins ranging from mental status of the accused to unlawful pretrial Command influence to expert assistance to the defense and his already bloated civilian and military docket calendar to extend this case out well into the middle of next year before any panel is seated and any actual evidence is presented to them.

Maybe the prescription should be to “take two” of those.
Don’t bet on it, he’s facing military court, now that doesn’t mean the wimp liberals won’t try to get his case move to civilian court, but military court isn’t the same as civilian, he’ll face his day, and hopefully death by firing squad, or preferably noose.

Thanks BlueLancer. I was trying to recap what I remember after almost 30 years in law enforcement, investigations and intel career fields in the military. I wasn’t intimately involved in the courts martial process but what got individuals there and testifying. Most is what I remember from having to study it in classwork.
Pity he’s not dead.
Maybe his neck will have added sensation when they hang him.
That process I believe makes it quicker to get to the top as opposed to the process in civilian courts.
And miss the opportunity to sue the deep pockets of the US taxpayers? Fat chance.

well, I am a betting man, and I’d be willing to bet on it, with you, were it not for the fact that the payday would be WAAAAAAYYYYY off, which was part of my point.
On another thread, I laid out reasons why I thought this would be the trickiest , most ‘treacherous’ and carefully controlled, and politically pre-determined trial in American History, for a whole lot of reasons no one has yet arrived at, apparently. And this whole new case of the 9-11
mastermind being removed from Gitmo to get a civilian trial, is being foisted on us by the AG and Obama, and it’s all to introduce a new dynamic running concurrent with the yet-to-be-determined Hasan trial. I hope to find the time to flesh out my ideas on this. Maybe as a individual post to FR.
If it’s not a ploy, but has a grain of medical truth in it,
it’s still going to be used for whatever they can get out of it.
We should do the humane thing and allow the terrorist to remain seated in his wheelchair as the noose is slipped over his head.
