Very well said. Having a clearance and actually having access to classified defense information are two different things.

PhiKapMom is also making good points on this...once you are given access, you sign a non-disclosure agreement that carries all kinds of nasty penalties.

It is a military hospital not a civilian hospital so security should not be a problem.

Ordinarily, I'd agree - but this was an extraordinary event. You can bet the hospital double and triple-checked even the doctors and nurses who were allowed to touch this guy.

Lethal injection. Although the electric chair was the prescribed manner of death for close to three decades, it was never actually used because of some appellate and Supreme Court decisions. The Army hanged a man in 1961 and then there was a long sabbatical from executions. In the early 80's, Reagan issued a new set of orders that met the newer Supreme Court rules and the death penalty was reinstated with lethal injection as the manner of death, although to date, no one has been put to death with this method.

Just a few years ago, Bush signed the first death warrant since Eisenhower in 1958 (for an execution carried out in '61) for Pvt. Ronald Gray. He was sentenced to death, but his sentence was stayed by a federal judge just a few weeks before it was to be carried. To date, that sentence is pending appeal. FWIW

Yes, you're right about his culpability under the UCMJ. But, given the circumstances of the day, I suspect that this crime falls within the definition of an act of domestic terrorism. And, as such, he would be eligible for the death penalty even in federal court under a number of violations of the US Code found in Title 18, more specifically the Antiterrorism and Effective Death Penalty Act of 1996 - which of course sprang from the criminal horror of the Oklahoma City bombing. That statute was expanded and enhanced with several post-9/11 Acts as well.

I'd think that Texas law would be far swifter and certain than an untested Federal statue. In fact, I'd bet a lot on that.

If the Military does not go for the death penalty (when was the last time we had a military execution?) the State of Texas needs to go hard and heavy. Texas capital law is very much tried and tested. They have the system down. It works virtually every time.

Just MHO as a layman.

No question. The military hasn't executed anyone since 1961 - hanging. As I said in a previous post, Bush approved the death penalty for a Army serial killer in 2007. A federal judge stayed that sentence and it's now working away through the appellate process.

If Texas took over, this guy could be dead within four years. But, there's no way that the military is going to give him up - not with the death of so many service men and women. And Obama isn't going to order them to give him to Texas.

Good questions. It would clearly cause him grief in the middle east. Of course, if he didn't sign it, it would cause him grief here in the States. There's a reasonable chance that he wouldn't have to make a decision, unless of course he's reelected - God forbid.

The DP Bush approved was for a murder/rape from 1987 - a long time ago. But, the Akbar case was much more recent, 2005 and that case has almost exhausted all mandatory appeals and will be decided by Obama probably early next Spring/Summer. Of course, Akbar can then appeal that decision by Obama, assuming Obama approves the Army request for death.

Think I was wrong about taking him to the local hospital and would bet they took him to Temple to the Level 1 Trauma Center after reading that they closed that hospital except for emergency cases. General said that was a CID person with him as well.

I still remember your postings on the OU bombing attempt. This convinced me beyond any doubt that the media actively nixes stories at nsa/whitehouse/whatever’s request in realtime.

Know for a fact that they killed a story at the OU Daily and confiscated all the copies of the story that were in draft.

The story that got me the most on OU’s “lone suicide bomber” was the one on his suicide note on his computer was found almost three weeks later and they wanted all of us to believe they hadn’t searched his computer after making 18 trips to the dump with explosives.

We were all treated like we were clueless and couldn’t think. They would have been better off to hold no news conferences.

I had the same feeling today that I had then — there is something being covered up.
