Orly Taitz appeals judge’s $20,000 sanction

Calling remarks made by U.S. District Court Judge Clay Land “nothing short of a political lynching,” California attorney Orly Taitz has appealed a $20,000 fine imposed by the judge for her actions in his court.

Taitz, a leader of the “Birther” movement that does not believe President Barack Obama was born in the United States, on Monday asked the U.S. Court of Appeals, 11th Circuit in Atlanta, to review Land’s Oct. 13 ruling.

Land’s rebuke stems from a Sept. 17 motion Taitz filed on behalf of former client Capt. Connie Rhodes, who sought to halt her deployment to Iraq on arguments that Obama couldn’t legitimately hold office.

Land denied the motion and Rhodes, an Army surgeon, was deployed.

Land told Taitz the previous day that she could face sanctions if she ever again filed a “frivolous” suit in his court. When Taitz filed the motion for emergency stay, Land gave Taitz two weeks to explain why he shouldn’t sanction her $10,000.

Land doubled the fine, stating: “While the Court derives no pleasure from its imposition of sanctions upon counsel Orly Taitz, it likewise has no reservations about the necessity of doing so. A clearer case could not exist; a weaker message would not suffice.”

Taitz took issue with the fines in her appeal. The judge’s actions “appear to be designed to silence her and intimidate her and above all, punish her for what the Court perceived as political rather than ‘core’ constitutional questions,” according to Taitz’s motion.

She said Land’s ruling will have a “chilling effect,” on the public to use the federal courts.

“Judge Land’s remarks amounted to nothing short of political lynching, which turned into a feast and celebration by the media mob,” the motion stated.

Land also gave Taitz 30 days from Tuesday to pay, adding that if she fails to, the U.S. Attorney “will be authorized to commence collection proceedings.”

On the deadline, Taitz, who no longer represented the captain, responded with a motion to recuse Land from the case and a request to extend her deadline.

... wherein the Court proved its pervasively extreme and outrageous (extrajudicial) prejudice.

Judge Land’s actions that amounted to misstating or misrepresenting ninety percent of what was presented in the pleadings and argument, completely ignoring ninety percent of the argument and facts, making extremely rude and demeaning remarks, showing bias; taken together, appear to be designed to silence her and, intimidate her and above all, punish her for what the Court perceived as political rather than “core” constitutional questions.

Judge Land might well have increased the sanctions amount from $20K to $40K or even $100K, all without specifying any real violations of Rule 11, even if such further filings were merely to show the undersigned counsel’s status as an attorney working pro bono without compensation, or to point out how the U.S. District Court had misconstrued some of the key precedents it cited in this case, including but not limited to Mindes, 453 F.2d 197 (5th Cir. 1971).

I wish the writer would clarify this statement. It is insulting as it stands.

If this periodical had real journalists they would address any number of issues raised instead putting forth unsupported assertions. "Birther" is a derogatory term directed to dismiss any questions or concerns about President Obama.

There were a number of ways to secure a birth certificate in Hawaii in 1961. The primary one is the long form that identified the hospital and attending physician. But if the child was not born in a hospital the applicant could still make a declaration and secure an equivalent to the long form as a Certificate of Live Birth. In this case there might not be a hospital or attending physician. The legal requirements for this avenue to acquire a Hawaiian Certificate of Live Birth were "loose" at the time.

Taking a look at the long form would clarify whether Mr. Obama was born in a hospital in Hawaii or elsewhere in Hawaii. Of course the possibility exists that a close relative could have secured a Certificate of Live Birth for Obama even though he was born elsewhere. Many people just do not know. They would like to feel assured that all is well and in order in this case.

The real story is the unprecedented lack of openness by our President in connection with his kindergarten records, Punahou school records, Occidental College records, Columbia University records, Columbia thesis, Harvard Law School records, Harvard Law Review articles, scholarly articles from the University of Chicago, passport, medical records, files from his years as an Illinois state senator, his Illinois State Bar Association records, any baptism records and adoption records, not to mention his sources of funding.

Oddly, though congressional hearings were held to determine whether Sen. John McCain was constitutionally eligible to be president as a "natural born citizen," no controlling legal authority ever sought to verify Obama's claim to a Hawaiian birth, or to certify that he is a "natural born" citizen (being as Obama has admitted that his father was a British citizen).

8. Then the king of Syria warred against Israel, and took counsel with his servants, saying, In such and such a place shall be my camp.
9. And the man of God sent unto the king of Israel, saying, Beware that thou pass not such a place; for thither the Syrians are come down.
10. And the king of Israel sent to the place which the man of God told him and warned him of, and saved himself there, not once nor twice.
11. Therefore the heart of the king of Syria was sore troubled for this thing; and he called his servants, and said unto them, Will ye not show me which of us is for the king of Israel?
12. And one of his servants said, None, my lord, O king: but Elisha, the prophet that is in Israel, telleth the king of Israel the words that thou speakest in thy bedchamber.

Here we have Elisha, with his spirit of prophecy, serving the king, as before helping the sons of the prophets; for that, as other gifts, is given to every man to profit withal; and, whatever abilities any man has of doing good, he is by them made a debtor both to the wise and unwise. Observe here,

I. How the king of Israel was informed by Elisha of all the designs and motions of his enemy, the king of Syria, more effectually than he could have been by the most vigilant and faithful spies.
If the king of Syria, in a secret council of war, determined in which place to make an inroad upon the coasts of Israel,
where he thought it would be the greatest surprise and they would be least able to make resistance, before his forces could receive his orders the king of Israel had notice of them from Elisha, and so had opportunity of preventing the mischief; and many a time,

They shall not know, nor see, till we come in the midst among them, and slay them, Neh. iv. 11. 2. All those devices are known to God, even those that are deepest laid. )
He knows not only what men do, but what they design, and has many ways of countermining them.
3. It is a great advantage to us to be warned of our danger, that we may stand upon our guard against it.
The work of God's prophets is to give us warning; if, being warned, we do not save ourselves, it is our own fault, and our blood will be upon our own head.
The king of Israel would regard the warnings Elisha gave him of his danger by the Syrians, but not the warnings he gave him of his danger by his sins. Such warnings are little heeded by the most; they will save themselves from death, but not from hell.

II. How the king of Syria resented this. He suspected treachery among his senators, and that his counsels were betrayed, v. 11. But one of his servants, that had heard, by Naaman and others, of Elisha's wondrous works, concludes it must needs be he that gave this intelligence to the king of Israel, v. 12.
What could not he discover who could tell Gehazi his thoughts? Here a confession of the boundless knowledge, as before of the boundless power, of Israel's God, is extorted from Syrians. Nothing done, said, thought, by any person, in any place, at any time, is out of the reach of God's cognizance.

This is old. It was filed on Tuesday, and it's not an appeal. It's labeled a "Notice of Appeal," and it should have been about 1-2 pages long, with no blathering -- just a basic statement that she intends to appeal.

Of course, Orly might think this is the way one appeals.

The court doesn't, since they have these things called "rules," which real lawyers are supposed to learn about in school.
