Judge Blocks Mandatory Flu Shots, Temporarily

The fight against mandatory flu vaccines has just gotten a shot in the arm.

An Albany judge has just issued a temporary restraining order preventing the state Department of Health from mandating flu vaccinations for health care workers in New York, according to lawyers in the case.

Terry Kindlon, the lawyer representing nurses who filed a lawsuit this week, said Judge Thomas McNamara issued the order at a hearing Friday morning.

The nurses argue the policy violates their civil rights. State Health Commissioner Richard Daines had imposed a regulation that required certain health care workers to be vaccinated by Nov. 30 or face being fired. Kindlon says New York is the only state in the country to require "involuntary vaccinations" for health care workers.

Two unions -- the Public Employees Federation and New York State United Teachers -- are also suing to reverse the policy. PEF says it encourages its members to be vaccinated against the flu, but opposes the emergency regulation requiring the vaccine as a condition of employment.

It is a violation of civil rights. If they can make the nurses do it today then tomorrow it'll be all of us, as if we're wards of the state who must do as we're told.

This at least gives these health care workers more time to settle their affairs and find work in other states.NY`s loss is everyone else`s gain.

So what? It is now accepted practice that sports figures undergo regular drug testing (but not politicians, doctors or nurses). What's the difference?

Drug testing is a little bit different than actually having an untested, unproven vaccine forced into your system and with no religious or philosophical exaemptions. This Dr. Daines azz apparently thinks we're living in some fascist state where he can snap his fingers and we're all supposed to jump like little soldiers. He has no authority to force this rule and I hope Judge McNamara and all the courts see through his bullying.

I do agree with you completely, as far as govt intrusion into the private citizen’s medical decision. Having said that, it is a long-standing law that children must get immunized before attending school. I don’t know if home schoolers are exempted or not. That, of course does not make it right. I do not agree with the forced drug tests for athletes either. I do agree with drug testing for airline pilots, train drivers, and bus drivers. I can see a reason for it with surgeons and anesthesiologists also.
