US House backs Guantanamo prisoner transfer 15 Oct 2009 17:26:42 GMT Source: Reuters WASHINGTON, Oct 15 (Reuters) - The U.S. House of Representatives on Thursday voted to allow the Obama administration to bring foreign terrorism suspects from the Guantanamo Bay prison to the United States to face trial.

The 307 to 114 vote removes one of many roadblocks the administration faces as it tries to empty the internationally condemned prison by January.

Where will us taxpayers pay for them to go on vacation to?
Puerto Rico? Even if the go to A U.S. fed prison they will obtain rights of American citizens. Yet again 0bama spits in our faces.

So...Maybe I am not aware of this. Can somebody tell me at what point in history has a prisoner of war been taken and put on trial for being a prisoner of war? Last time I checked they were caught on a field of battle during an armed conflict. Kinda makes them a prisoner of war, don’t it? Generally,what happens is that they are in the POW camp until the conflict ends. That’s how it works, no?

Can someone PLEASE explain to me why we are wasting time and money on these prisoners of war for something like this?!

I think we should make everyone of these prizoners a page in the U.S. Congress assigned to the members who signed this legislation.

The rest could become guest workers on Nancy Pelosi's Winery.

They are not "Prisoners of War" but Enemy Combatants. The difference is that Prisoners of War, under the Geneva Convention, wear a uniform and have identification tags indicating the country they are fighting for.

The Genius of the Geneva convention is not Prisoners of War, although that was a nice byproduct - Not torturing Soldiers - but the fact that those Outside of the Convention clearly Could Be Fully Tortured - discouraging guerilla warfare and terrorism. By weakening the Geneva Convention, giving rights to those without uniforms and Country ID tages, it has invited the kind of warfare that the convention was intended to address.

Historically? [1] Nuremberg. The principal trial included Keitel and Jodl from the Army, Raeder and Doenitz from the Navy, and Goering from the Air Force, all POWs.

[2] the Malmedy Trial. Defendents included the following Waffen SS officers, who were surrendered prisoners of war: SS Col. Gen. Josef ‘Sepp’ Dietrich, SS Brig. Gen Hermann Preiss [or Priess], SS Lt. Col. Joachin “Jochen” Peiper.

[3] The Manila Trial. Chief Defendant Gens. Tomoyuki Yamashita and Masuharo Homa.

[4] The Tokyo War Crimes Trial. Included Gen. Hidecki Tojo, Gen. Doihara, Marshals Terauchi and Sugiyama.

But those were charges of crimes against humanity and war crimes, no?

I could be completely wrong. Just regular joe 6-pack soldier captured on the battle field.

I am also aware that these people are not wearing uniforms so therefore not soldiers, yada-yada, I get all that.

They were caught on a battle fied in armed conflict. So therefore prisoners of war in my opinion. I do realize I am looking at this at very elementary level. What I am basically saying is that why clutter up our already screwed up court system. Military tribunals was fine and more than adequate.

Different issue. Sorry I misunderstood.

Under the Geneva Convention, the protections accorded to a POW only occur if he is a soldier of a sovereign power, and is in a clearly identifiable uniform of his country. The identification may be based on as little as a badge, a headband or armband with specific markings, any item which appears uniformly on that side’s combatants. The country also has to be a signatory of the Geneva Conventions.

Clearly, Al Quaeda terrorists are out. They are not uniformed in any way, nor do they represent any recognized government or country. They are not covered by the Geneva Conventions. In fact, they could have been shot out of hand under the appropriate international law.

Taliban fighters are a little different. The Taliban was a government of a country. But, no uniforms of any kind on the troops. Kind of like Skorzeny’s SS troops during the Bulge in U.S uniforms. They were shot. So the Taliban troops are not technically POWs either.

That doesn’t mean I subscribe to the Clinton/Obozo, “They’re all from one of the Five Families” approach. Terrorism isn’t RICO. It’s an act of war. And Taliban captives, while not necessarily Al Quaeda types, and not necessarily POWs, shouldn’t be prosecuted in Civil Courts either. Hope this helps.

Marky voted FOR transfering the prisoners out of Gitmo to the mainland? If he did that's another example of Kirk lying about his record to get elected. Kirk apologists claim he "supports the Republican position" on Gitmo. Marky Mark and his supporters also claim he "doesn't take earmarks" (I can post a link to the millions of dollars in earmarks with Mark's name attached to it). They also claim he supports "the Republican position" on illegal aliens (news to any illegal alien watchdog group that gives Kirk mediocre lifetime ratings)

I'm trying to go to thomas.loc.gov to find the roll call vote using the number you gave me but it's not returning any results. Got a link? I'll post it on Illinois Review for other IL conservatives to see.

Also don’t forget our little pal voted against drilling in ANWR, sponsored legislation to resurrect the so-called Assault Weapons Ban, and recently voted to give the FDA more power to regulate herbs and vitamins. He is also openly supportive of the illegal Mexican community in Lake County i.e., the Tonatico crowd. They marched with him in last year’s Fourth of July Parade in Waukegan.
