CROWN TAKES STEPS TO APPEAL KHALID SENTENCE (Canadian "Toronto 18" terrorism case)

OTTAWA – September 30, 2009 – The Public Prosecution Service of Canada today announced that it plans to appeal the sentencing decision in the recent case of Saad Khalid.

The PPSC is seeking leave to appeal to the Ontario Court of Appeal regarding the sentence of seven years in addition to time served, which was imposed on September 3, 2009.

On May 5, 2009, Khalid pleaded guilty to a count of “doing anything with intent to cause an explosion of an explosive substance that was likely to cause serious bodily harm or death to persons or was likely to cause serious damage to property, contrary to section 81(1)(a) of the Criminal Code, for the benefit of, at the direction of, or in association with a terrorist group … thereby committing an offence contrary to section 83.2 of the Criminal Code.”

The decision to appeal is guided by policy outlined in the FPS Deskbook, which is a public document.
