The Supreme Court announced this morning it will hear a challenge to Chicago’s gun restrictions that will determine if local handgun bans are legal.

Last year, the high court ruled the 2nd Amendment gave individuals the right to possess firearms and struck down Washington, D.C.’s gun bans.

Left open was the question of whether states and local governments are required to do the same.

By agreeing to take up the cases National Rifle Association vs. City of Chicago and McDonald vs. City of Chicago, the high court potentially could set in motion a nationwide re-establishment of the right to bear arms. Those two cases challenge several Chicago gun laws, including the city’s ban on handguns.

In the high courts decision in June of last year, it ruled 5-4 for the first time that the 2nd Amendment establishes the right to own a handgun for personal self-defense, not only as part of a state militia.

Mayor Richard Daley immediately condemned the court’s decision and vowed to fight any attempt to invalidate the city’s now 27-year-old gun ban.

Hours after the court’s decision, the Illinois State Rifle Association sued Chicago and Daley in an attempt to overturn the ban.

One of the plaintiffs is Otis McDonald, an elderly man who last year lived in the Morgan Park area and told the Chicago Tribune he keeps a shotgun at home to protect himself from gangs that plagued his neighborhood.

After the court ruled in the Washington, D.C., case, Morton Grove, Wilmette, Evanston and Winnetka dropped their gun bans, in large measure to fend off costly lawsuits.

Mancow is talking about this on WLS now. If Obama loses the Olympic pitch and the handgun ban gets overturned poor mayor Daley will probably be found hanging in his closet from depression.

Praying they uphold our Constitution. Gun Control in Chicago has done NOTHING to stop the murderous gangs and criminals. If law-abiding citizens were able to defend themselves crime would go DOWN, not UP! [Of course, the gang bangers will still target each other, but that hasn’t changed in DECADES - with guns legal or without!]

I cant remember how the vote went on the last case that said individuals have the right to bear arms?

was it 5-4 ? and was Kennedy in the majority? In other words will Sotomayor make a difference?

Any doubt how Sotomayor will rule? No, none.

Looking for a good outcome to support the ruling that RKBA = individual right as the gun banners arguments continue to unravel.

I so fear the justices that Obama will appoint. Two conservatives on SCOTUS are the best thing to come from the Bush Administration. Bush was no conservative, but he leaned that way at times and I’m glad SCOTUS appointments were among those times.

Almost as much as I fear Obama’s SCOTUS appointments, I fear disgruntled Republicans who will vote 3rd party and give Obama the chance to appoint more SCOTUS judges during an 8 year administration. That terrifies me. Bad as McLame is, we would not have gotten a Sotomayor. He would have given us someone left of center, but not left of Lenin.

Is this the beginning of the end of the Republic?

Imagine the Men in Black issuing a ruling affirming the gun ban in Chicago. Now, there is legal precedent in doing so, so hundreds of other liberal cities follow suit - San Francisco, New York, all the rest...

Is this the “from my cold, dead hands” part we’ve always warned about?

Of course, the Supreme Court can do the right thing and rule how the founding fathers intended. But pardon me for not holding much faith in government right now...

the court will strike down the ban as unconstitutional. normal, law abiding citizens with go on a gun buying frenzy, and crime rates will drop dramatically and impressively in a super short time. the voters will see what their stupid dem government has wrought on the city and vote them out. repub candidates will win in all precincts, sweeping the dems and their corruption out of the city and inevitably the state, and chicago will be cleaned up. within 3 yrs chicago will be a shining example of american can do spirit, clean, plenty of new jobs, low crime rate, low taxes, and no more corruption. a veritable heaven of conservative ideals. ..............or not.
