Everyone keeps saying no laws were broken...but do you need the act to take place to have a conspiracy?

The act does not need to take place for a conspiracy. An example would be for someone to offer to pay money for someone else to pay for killing a business associate. The law does not require that the killing actually take place before an arrest can be made. ACORN offered assistance to break multiple laws. The laws don’t need to actually be broken for an investigation to begin.

Not if it to say blow up a plane or a train station - the government has put many of those in jail.

Its a good question however and why I think the RICO act is a better approach then state laws on any of this.

Technically no. Just planning a crime between two or more persons constitutes a conspiracy.

Get recorded in some dark alley asking a shady goon to snuff your spouse and find out how fast “conspiracy to commit murder” lands on your head, even if the spouse is never harmed.
