Would Obama have any say in the matter? Wouldn't the judge order Hawaii, the passport agency, and schools to had over the documents?

Obama will claim Executive Privilege and use his newly minted Executive Order to keep the records sealed until they are lost or misplaced. In any case I do not expect the birth certificate to appear.
Obama will appeal all the way up, while all the time delaying and obstructing till he either finishes his term or he can get the Constitution amended retroactively.

The instant Discovery is ordered, the DOJ will immediately move to seal the entire proceedings from the public. We won't even get to know what Orly has tried to subpoena, much less what gets entered as exhibits in the court case.
