Let’s say there are two roommates, Joe and Bob, who look similar- same hair color, height and weight. Joe brings home a woman one night and has sex with her. After he’s done, he leaves the room and wakes up his roommate Bob and tells him he can now have his turn. Bob goes into the darkened room and the woman, thinking he’s Joe, has sex with him. Is this rape?
