Now a case for you.

Now let's say someone breaks into a house and has sex with the lady of the house. Since she has taken a Ambien and is not really awake she thinks that he is her husband.

In your opinion, Rape?

Yes, your example is rape. But I’m confused about your answer. What do you mean she knew who she was having sex with? In both my examples, the woman thought she was having sex with one particular person and she would never have consented if she knew they were not that person. The only difference is, in the second example, she could see the person.
