What is the crime?
Making people believe a falsehood is not a crime. If it were, Allan Funt would be a wanted man.
As long as the forger didn't try to sell as something it wasn't, make money from it in some other way, or use it him/herself as what it was purported to be (Obama using it as his birth certificate) what, exactly is the crime?
And even if it were a crime, it would only be a crime in Kenya/Zanzibar/wherever. Not in the United States, unless someone was enticed to spend money on the forgery (Hey! Wanna buy a Picasso?). Kenyan law doesn't extend here.
As long as the forger stays clear of Kenya (and how often do you accidentally find yourself in Kenya?), he/she should be home free.
Writers as prominent as Mark Twain and HL Menchen have taken part in public hoaxing. It's not a crime.

The law as noted in post 80 of this thread is against producing such a document, not selling it or anything else, if you are not authorized to do so, producing it is breaking the law and carries the criminal sanctions specified.
