Per the state dept. manual of foreign affairs that requirement only applies to women married to a foreigner.

If O’s father was not really divorced from other wife(read this on some other thread-do not know if true), then she would have been an unwed mother with completely different rules. Just had to have lived in US for 12 months continuously at some period prior to birth.
