Soldier's case against Obama to be class-action?

A case brought by a military officer whose order to deploy to Afghanistan was revoked now has been refiled in a federal court in Florida, and it raises the specter of a class action claim among members of the military that their orders aren't valid because of Barack Obama's ineligibility to be president.

The possibility already had been raised by WND columnist Vox Day, who wrote, "Not only every deployment order, but every order issued from an officer in the line of command can now be challenged in the knowledge that the top brass are afraid to respond for fear that their commander could be exposed for a fraud."

His comments came after the military, in its attempt to resolve the questions raised by Maj. Stefan Cook in his original claim, simply revoked his orders to deploy. As a result, a federal judge in Georgia dismissed his case. It now has been refilled in Florida, where he lives.

"The Pentagon's decision to back down rather than risk exposing Obama's birth records to the public means that every single American soldier, sailor, pilot and Marine now holds a 'get out of war free' card," Day wrote.

Now that scenario has been raised again in the new claim.

"It was already obvious that this case had and still has the potential to be converted into a class action on behalf of all military servicemen and women who require the means of establishing the legality of their orders with certainty," the document states.

It wouldn't surprise me if whomever signs on as a member of the class gets charged with MUTINY.

Appropriately so. Absent a legal ruling otherwise the Service Chiefs must assume Obama is legit...he was sworn in by the Chief Justice for cryin' out loud.

That said, the discovery portion of such a trial would be interesting...to say the least.

Again I ask... what is 0bama hiding? If 0bama has been telling the truth, then there should be nothing at all embarrassing, incriminating, or otherwise a problem. So SOMETHING is wrong - that is the ONLY explanation.

On the contrary, considering there has been no proof to verify his eligibility it is reasonable to assume he is not eligible.

The Chief Justice does not verify his eligibility. That's Congress's job. The Chief Justice assumes the person has already gone through the verification process.

Wouldn’t it then be on Obama/DOD/Army to prove Obama’s eligibility?

And wouldn’t the right to compel witnesses & evidence for your defense basically allow them to gain access to (subpoena) things like: college records, passports, adoption papers, and (yes) the long-form birth-cert?

All you said is true yet at the same time they are sworn to defend against all enemies foreign and domestic.

When the enemy happens to be the general everything gets confusing.

This guy’s military career and his pension are history. It will be done slowly and quietly but it will be done to make an example of this soldier.
The military has never taken kindly to disobeying orders and orders go up the chain of command. The court martial won’t involve disobeying the Commander-in-Chief’s orders, it will focus on disobeying his direct superior officer’s orders.

In a civilian court, perhaps, but this will be a general court martial under the Uniform Code of Military Justice, a very different scenario.
Its very cut and dried: you disobey an order from a direct superior officer, you’re history.

Didn’t this brave younger man just risk being charged with mutiny or a simliar charge and they blinked? They cancelled his orders.

I can think of two reasons why they did that though there may be more:

1. Obama is not eligible and at a trial for mutiny or whatever the charge - this young man would be given the right to demand proof.

2. He is eligble and they are jerking us around.

Well we know his father was a British citizen so we already know he is NOT eligible.

And why is the media all ramped up on discrediting this including O’Reilly and Ann Coulter? In this discrediting - the story keeps changing from CNN, Hawaii and others. A new story every day.

When the cops are questioning someone and they change the story - what is the end result? The person is lying. See the stripper is the Duke case. A new day and new story.

I said 10 months ago that the military was the best way to get to the bottom of this. The military is teling the judiciary aka third branch of govt to do their job before the military decides it is forced to become the fourth branch of govt.

Yes, he might be charged with mutiny, but at the courts martial he will be allowed to present evidence that would exonerate himself. And as a part of that evidence will be one doctor signed, expert verified, BHO birth certificate.

You just may be right. Who is to say how history will go though. Obama, should he be forced to show this birth certificate, will be found to be a LIAR. That is a 100% guarantee. Whoever forces his hand WILL MAKE HISTORY.
