Do you think Kay Bailey would have said this?

No. I can hear her now. “Well, we look forward to looking at whatever President Obama comes up with and discussing it”

“I think we can come up with a bipartisan solution that helps all Texans”

“I look forward to working with my Democratic colleagues”

I'm relatively sure Perry is speaking in terms of ideas and not about any plans or upcoming legislative action.

Remember that he was the subject of a media attack when he suggested back in April that Texas could constitutionally secede from the Union.

That said, I would be in favor of Texas taking such action based upon the 10th Amendment.

Remember politicians never change and Rick Perry’s strategy to win the governor election is to be the “Right” of RINO Kay Bailey Hutchinson.

I believe that since federal power/law falls directly upon the individual and not the States, the only effect the State could have is in refusing to participate in implementation. Usually State implementation is purchased as part of a program with financial strings. That means the State has to be willing to forgo the money that will come along with the program - most likely affecting the Medi-Cal/Medicaid program and other health money from the feds.

The feds will still require the individuals and businesses to participate. (The State can do nothing about that unless it participates in a lawsuit challenging constitutionality of the federal program brought by some individual/business with a substantive interest.)

Well, I sure won’t hold my breath but I can always hope. I like the comment “Don’t DMV my healthcare”, good one! Us Texans can relate to that one.

It’s truly a sad state of affairs when a state has to throw the 10th Amendment into the mix. I cannot think of a time in American history short of actions that led to the Civil War in which this happened. Anyone have an example where a state has invoked the 10th Ammendment in the last century?

Rick Perry just stated on Mark Davis' show that Texas may use the 10th Amendment to reject Obamacare.

Maybe Gov Perry should read the last page, #1017, of HR 3200 before he decides

Subtitle E—States Failing To Adhere to Certain Employment Obligations
SEC. 2541. LIMITATION ON FEDERAL FUNDS.

A State is eligible for Federal funds under the provisions of the Public Health Service Act (42 U.S.C. 201 et seq.) only if the State —

(1) agrees to be subject in its capacity as an employer to each obligation under division A of this Act and the amendments made by such division applicable to persons in their capacity as an employer;
and
(2) assures that all political subdivisions in the State will do the same.

So if he's ready for a squeeze he better be ready to squeeze back by NOT sending any money to DC.

Dear Governor Perry,

On March 30, 2009 the Texas House of Representatives passed HCR 50 affirming that the State of Texas claims sovereignty under the Tenth Amendment.

You have publicly supported this bill, and stated that attorney generals from all over the union could be getting ready to sue the US Government.

We are asking you to take the lead.

We are asking you to order the Texas Attorney General to publicly begin working on a law suit under Article IV, Ninth, and Tenth Amendment of the Constitution.

We are asking you to protect the citizens of Texas that we will not stand for government controlled healthcare in our state.

Under your leadership we can effectively kill the proposal of this administration and allow Texas to be a state free from socialism and collectivism.

Be the voice of reason in the national debate and allow Texans the ability to solve the problems of our state.

Thank you,
