The robber killed by a pharmacist in May died from gunshots to his body, not the shot to his head, the state chief medical examiner confirmed in the autopsy report.
Antwun Rayshaun Parker, 16, of Oklahoma City was knocked out after being shot in the head and would have survived that injury, Dr. Collie Trant told The Oklahoman.
Pharmacist Jerome Jay Ersland is charged with first-degree murder in a case that sparked a national debate. Prosecutors allege he went too far because he shot the robber five more times after knocking the robber unconscious with the shot to the head. Ersland said he acted in self-defense. He said in a nationally televised interview that he thought the robber was getting up.
The autopsy report released Tuesday describes the first wound as a "non-fatal gunshot entrance/graze wound to head.
Trant explained the first shot involved a three-pellet shell.
Parker was shot five other times to the chest and abdomen, the autopsy report shows.

After watching the video.It appears Jerome Jay Ersland was over the perp for 2 maybe 3 seconds.

I thought the pharmacist was deaf. If he is, then he can only rely upon his vision. If he sees the perp move, then the threat remains. Prudence dictates that you remove the threat.
Security cameras are not filmed in real time. The timer on a security camera only shows how long the video is and not how long the actual event transpired.
count the elapsed seconds during the event.

The video shows nothing of the sort. He didnt have a gun, he dropped at the shot. He wasnt diving for cover, he was shot in the head. Talk about willfull ignorance. I would love to give the pharmacist benefit of the doubt but he clearly exceeded the law.

Did you notice how choppy the druggist moves through the clip? Real live people don't move like that. The security camera is only taking a very short number of frames per second. If you still don't understand how a security camera works, call someone at an electronics store and they'll try very hard to explain it to you.

This is a level of stupidity rarely seen so I will re-state so that even you can understand. Five shots in 2-3 seconds with a gun already in hand at a range of a few feet is so easy that virtually ANYONE could do it.
This is not first degree murder. It is likely not even second degree murder. In light of the violent provocation initiated by the dead man his accomplice it is most likely a variety of voluntary manslaughter (however denominated under Oklahoma law). It is homicide resulting from an imperfect right of self-defense.
And the accomplice will share responsibility for the death and will receive a much stiffer sentence.

The time and date stamp caption clearly reads month / day / year hours in military time : Minutes : seconds . parts of seconds. Did it not occur on May 19th 2009 at 3:40 PM ?
the shooter was an average citizen not a Trained Law officer...If a thug pointed a gun at me and I didn’t freeze in terror, but reacted with fear and rage I would keep shooting and shooting.

If you have some sort of medical problem you can have someone explain this post to you.
Security cameras don’t measure real elapsed time. A security camera could record somthing in ten seconds but the event could have taken ten minutes.
If that is still unclear, post to someone else to have them explain it to you.

It's called "perseveration". I learned the word as a juror on murder trial.
Personally, I think 70% of the country would agree with a law of that sort.
As it is, the law protects the BG all too often.
This nation needs an “Open Season Doctrine”...as it is, there is little disincentive for these thugs to do what they do.
