Bombshell: Prominent Attorney Accuses Sotomayor of Possible Ethics Breach

The following letter was confirmed to me by Mr. Greenberg with the following statement:

"The letter was sent to Senators Sessions, Hatch, Grassley, Graham and Coburn. It was also sent to Cong. Peter King (R) NY. The story is being covered extensively by the photo blogs, the trade publications and the NY Times. No politician has responded. The NY Times quotes attributed to me are accurate and therefore I assume that the quotes of my adversary Mr. Fairhurst are accurate as well."

Text of the letter:

I am an attorney in NYC who represented White House Photographer Chris Usher in litigation against Corbis, a privately held company wholly owned by Bill Gates. The case principally concerned lost Presidential and campaign photography during the 2000 Bush v. Gore Campaign and the US Supreme Court case related thereto.We won at the trial level in the United States District Court for the Southern District of New York but the award to the victorious plaintiff was absurdly low.

We appealed to the 2nd Circuit Court of Appeals where the award was inexplicably upheld. The New York Times reported on this high profile case today, please see:

It was revealed therein by opposing counsel hat Judge Sotomayor and Mr. Gates’ counsel have known and (possibly worked with) each other for decades. Such relationship was never disclosed to me as plaintiff’s attorney by the Court. No opportunity for us to request that Judge Sotomayor recuse herself was afforded as this information was never disclosed.

The appearance of impropriety is astounding as Judge Sotomayor could have recused herself and we could have had another Appeals Panel within days.

Please contact me so that this apparently unethical judicial behavior is brought to the attention of the judiciary committee immediately.

Sotomayor trashed the Appeal by James and Elizabeth Sanders who were wrongly charged and had their Bill of Rights stolen under the Clinton’s Regime. After being found Innocent on Appeal, they sued for Damages and Sotomayor summarily dismissed all of their Rights. Please note Dr. Cashill’s fine article detailing this travesty on his website today:

Actually, Sotomayor will likley pass fromt he committee tot he floor of the Seante for an up or down vote absolutely along party lines. Graham will no more vote for this woman than Jeff Sessions will.

To everyone on this thread who believes that we may as well walk away from the effort here.....I would say this.....

There is far too much blood spilled for the Constitution to shrug our shoulders and blow off any effort here. Every issue we care about either starts or ends up in the courts so it matters who is in those black robes who will be deciding the fate of our Constitutional principles. And it matters not just for that case, but for a generation.

There HAS to be a cost to these people for this outrageous nomination. To let it stand and not say a word about it simply because the outcome seems to be all but settled is beyond foolish. The American people need to know the type of extremist liberals they are apparently determined to pack the courts with. This is no thoughtful jurist....this is a full-fledged political activist with a freedom-killing agenda, make no mistake about it.

There are all kinds of victories, friends. I remember when the naysayers out there said constantly that there was no way that the American people would even come close to caring about or understanding the importance of this issue. That changed dramatically when, against the odds, we put our shoulder to the rock and started pushing it up the mountain. For two glorious elections, the judicial nominations issue worked like a champ. Then they abandoned the issue and well, apparently all principle too.

So give it up and walk away cause the vote isn’t going our way? HELL NO.

Our movement’s motto should be a lot more than “We FIGHT!.....er, only when we can win.”

You’re right ... a judge KNOWING another attorney ISN’T unethical. However, failiing to disclose a close relationship with an attorney appearing before that judge IS.

Republicans don’t have the Hispanic vote anyway, so why should it matter? They need to remember who DOES get them elected instead of being afraid of pi$$ing off those who don’t vote for them anyway. That’s the reason they’re out of the majority at this point.

- and mucho more.....

Weekend “guests” were fed, state, local Judges, attorneys, Commissioners

Why did I retain him?

He had the goods on a crooked Judge and and a crooked lawfirm (I had once trusted and used) that was attempting to extort cash and an interest in a mucho profitable and legal unique business I had developed on my own

He delivered in a very few minutes

Fear is effective

He was a cross between General Patton & J. Edgar Hoover

Better than me relying on more direct methods that would have changed my lifestyle or my body temperature

Don’t tell me about legal ethics or how the game is played

Sotomayor is dirty and everyone knows it

Review her personal financial dealings - “sloppy” or “careless” does not cover it

So sue me!

Next time I may resort to more direct methods

I remember the thunderous cheers and standing ovations President Bush received when he spoke about judges on the campaign trail in 2004. We dethroned Tom Daschle and got up to 55 senators in that year's elections.
