One person who is not so thrilled about the prospective elevation of Sonia Sotomayor to the United States Supreme Court is a man named Jeffrey Deskovic. Mr. Deskovic spent 16 years in prison for a crime he didn’t commit — the last six years, Deskovic claims, being a direct result of the actions (or, rather, the inaction) of Judge Sotomayor. Surprisingly, he chose to tell his story last night to, of all people, Amy Goodman, the far-left host of Democracy Now!
Was he white?
Did that have anything to do with it?
That’’s a great place to start... after all, there cannot be “Social Justice” without Justice, right?
This guy has every right to tell why Sotomyer is unfit for the USSC.

a case like this is something ALL Americans can understand.........it could shut her out.
No , not surprising. He's either being paid bucks or just wants his 15 min. after being culled out for the Left's agenda. They like to put it out there, polarize it, make the spin and say, well that's all folks. No more to disgust.
OR Goodman is one of those Democrats who are polling a lack of confidence........
$10 says a smear campaign against this guy is being formulated as we speak...
That looks good on her resume - to other liberal wackos. It will not affect her chances of being nominated one bit, in fact, it should enhance her chances.
the left LOVES compelling stories........he was WRONGLY convicted of rape at age 16, 10 years later the DNA evidence emerged that could clear him......because of a procedural issue Sotomayor ruled against him......6 more years go by before he gets a second shot all the while KNOWING the evidence exists to clear him.....so half his life at that point he spent in prison for something he never did. he lost his entire teen years and his twenties.......and she did NOT care.
this “wise latina woman” shtick is getting very old....nothing wise about leaving this man in prison.

So you're saying that this information is irrelevant to the confirmation process for Sotomayor? Surely you aren't saying that, are you?
From Rehnquist's opinion: “Were petitioner to satisfy the dissent's ‘probable innocence’ standard…the District Court would presumably be required to grant a conditional order of relief, which would in effect require the State to retry petitioner 10 years after his first trial, not because of any constitutional violation which had occurred at the first trial, but simply because of a belief that in light of petitioner's new-found evidence a jury might find him not guilty at a second trial.”
O'Connor's concurring opinion: "Consequently, the issue before us is not whether a State can execute the innocent. It is, as the Court notes, whether a fairly convicted and therefore legally guilty person is constitutionally entitled to yet another judicial proceeding in which to adjudicate his guilt anew, 10 years after conviction, notwithstanding his failure to demonstrate that constitutional error infected his trial."
The court's opinion is that these cases are what pardons are for.
I am definitely NOT a legal scholar.....but this case screams of injustice. and she had it before her six years earlier and did nothing......I would think a “wise latina woman” would have seen it.

Sounds like some liberal made it up along with "historical present tense" and using "gender" to mean "sex."
Again, this is what pardons are for. If there were no procedural violations in the trial and the defendant was convicted fair and square, his recourses do have limits and are subject to rules. Deskovic presented no evidence to Sotomayor that wasn't available to the original jury.
call me naive.........but she did not care about this white man and justice. if the evidence was found to free him and NOTHING got done about it? perhaps laws need to be changed, but to leave him there and do nothing? procedural issues? if it was YOU in jail what would you be saying? I want justice in my justice system.......I do not want them making new laws like abortion. however, this was appalling.
