He has not refused to serve! He's still active duty US Army, subject to all the in’s and out’s of the UCMJ. He is simply exercising his right to be certain that an order he's been given is legal, legal enough to protect him for following it.

Just heard the military said HE DOESN’T HAVE TO GO!!! No need for a BC now. He can stay home.
