Soldier refuses to serve, cites Obama's lack of U.S. citizenship

A U.S. soldier refuses to deploy to Afghanistan, saying that President Obama cannot be Commander in Chief since he is not a U.S. citizen. The soldier's lawyer has challenged Obama's legitimacy before.
In a stunning conscientious objector case, a U.S. soldier has refused to serve in Afghanistan, citing President Obama's U.S. citizenship. U.S. Army Major Stefan Frederick Cook says he should not have to go to the war-torn country because Obama is not a legitimate president and therefore has no grounds for sending troops anywhere.
Cook's lawyer, Orly Taitz, has filed a request for a temporary restraining order. She has filed other claims against Obama's legitimacy in other courts. "In the 20-page document — filed July 8 with the U.S. District Court for the Middle District of Georgia — the California-based Taitz asks the court to consider granting his client’s request based upon Cook’s belief that Obama is not a natural-born citizen of the United States and is therefore ineligible to serve as commander-in-chief of the U.S. Armed Forces," the Ledger-Enquirer reported.
Cook “would be acting in violation of international law by engaging in military actions outside the United States under this President’s command. ... simultaneously subjecting himself to possible prosecution as a war criminal by the faithful execution of these duties,” Taitz stated.
Obama claims to have been born in Hawaii in 1961, just two years after it became a state.
A bigger question...what would happen to all the legislation enacted under his illegal presidency? The Money, the corporate takeovers, the executive firings, the executive orders, the czars..and on and on. Its going to be a gigantic mess and it gets worse and worse everyday it continues.
WE NOW HAVE OUR ISSUE! EVERY MILITARY MAN ORDERED TO IRAQ OR AFGANISTAN MUST USE THIS DEFENSE. THEY CAVED BECAUSE OBAMA DIDN’T WANT TO FIGHT THIS IN COURT! THIS COULD BE THE ONE THAT SMOKES HIM OUT AND FORCES HIM TO DIVULGE WHAT HE HAS FOUGHT FOR SIX MONTHS AND A MILLION DOLLARS IN DEFENSE ATTORNEYS.

Wrong! according to the constitution. He is removed and tried for treason along with any conspiritors.
I do not believe it would be Biden, they both ran on the same ticket, therefore one would nullify the other. the other party would be the de facto winner of the election.
You may be right, but I think I've read that a VP is technically elected separately, thereby capable of serving if the President is impeached or otherwise removed from office.
The talk radio guys are not going to touch this until it comes out in a major way through a lawsuit which gets a hearing(which is why they are doing it now a little). They don’t want this issue to be about ‘them’ or things they have ‘said’ when it all bubbles to the surface. That would just hand the Obama brownshirts an excuse to obfuscate the issue by calling it a right wing/talk radio conspiracy theory. When it starts coming out in the newspapers and on TV as ‘news’, they will begin discussing it openly.
That’s my theory anyway.

It would. Each and every service member serving overseas - nomater where they might serve.
Although R. Limbaugh has avoided discussion of this topic, I note that he’s now repeated several times without further comment the joke “How are Obama and God alike? - neither has a birth certificate”...maybe some day he’ll become brave and tackle the issue fully.....

He has not refused to serve! He's still active duty US Army, subject to all the in’s and out’s of the UCMJ. He is simply exercising his right to be certain that an order he's been given is legal, legal enough to protect him for following it.
Only under constitutional law if the president elect is removed for cause, seeing as this would /could be considered a conspiracy of fraud by one political party, all elected officials would be suspect.
I would enjoy that scenario.

If he is not a US citizen (hence the bc & Indonesian PP) would the charge not be something other than treason? sedition, or acting as an enemy combatant, or saboteur.
Would all of his appointments and executive orders become null & void
As far as conspirators would both houses be subject to treason charges for certifying him?

The EC votes on each separately - meaning that Biden himself is still “legit” and would be President.
