Twenty-three AGs tell Holder no dice on semi-auto ban renewal

On June 11, 23 state attorney generals signed and sent a letter to Attorney General Eric Holder advising him that they are opposed to renewal of the 1994 Clinton administration’s ban on semiautomatic firearms, erroneously dubbed “assault weapons” by proponents of the ban The 23 state Attorneys General who signed the letter are: Arkansas – Dustin McDaniel Alabama - Troy King Colorado - John W. Some argue whether the 2A applies to states or justs the feds. There is a split on incorporation between circuits (Sotomayor) that will have to be ruled on by SCOTUS.

Regardless of this split, the big change since the ‘94 ban is the SCOTUS ruling in Heller that the 2A IS an individual not a collective right. For this reason alone, a new ban by the feds should be unconstitutional this time around.

One question:

Do they really think that we’ll give them all up?

We know why they will want to Register/Confiscate them – and it isn’t about crime or any of that nonsense.

They should also know that nothing says that you have to keep all your guns in one place.
Sort of a variation of ‘keeping all you eggs in one basket’ theory.

That's why a new AWB would be political suicide. Prior to the first AWB, there were only about 250,000 "assult weapons" (per the 1994 definition) in circulation. Now there are anywhere from 4-8 million of them with the AR-15 platform being the most popular sporting rifle in the country. Bill Clinton was the best gun salesman the country had ever seen until Obama came along. Americans have bought millions of these $1000+ rifles and many of these weapons have been tricked out into $3000+ rifles. They're not just going to hand them over.

Please inform Mr. Workman that the plural should read “attorneys general” NOT “attorney generals.” Sort of like “sergeants major.” It’s important for many of us in the English-as-official-language battle to use the language properly especially when we’re countering the liberal slide into Spanglish or something equally stupid.

Unhappily, millions are likely to do just that.

Unless you bought the rifle at a private sale, there is paperwork on it at the point of sale which is illegal to destroy. ATF will get that paperwork when they deem the time right. Then, it is just the little matter of contacting the owner and demanding to hand it in - perhaps at a small buyback, perhaps not. Model, serial number, date of purchase, etc. will be included.

Threats of penalties of 5 years in prison and $50,000 fines will persuade many. The authorities won't even have to come to your house to get the weapon. A certified letter and threats of further court action and penalties will suffice.

It will be an operation just like the IRS does on unpaid taxes; one person at a time, very personal, and threats of even more penalties.

Forget about the "boating accident" excuse. Any law requiring the confiscation of weapons will close those loopholes and it will cost you plenty if you don't surrender the specific firearm.

Specific performance will be required or it will likely be prima facie evidence of a crime, because at that point the Constitution and your protections under it will be effectively dead.

You don't imagine the totalitarians that will do this are going to be concerned about your civil rights at that point, do you?

If all else fails, they can always sent in the SWAT team at 3 AM to apprehend the individual felon, er, you and toss your house looking for the forbidden weapon!
