Obama Administration Reluctantly Adopts Rule Requiring Federal Contractors to Use E-Verify

WASHINGTON, July 9 /PRNewswire-USNewswire/ -- Late yesterday, the Department of Homeland Security (DHS) announced it would move forward on a Bush-era regulation requiring all federal contractors to use E-Verify. This announcement is welcome news, but it also represents a last minute attempt by the Obama administration to fend off a proposal to impose more stringent standards that the Senate was considering on the same day, says the Federation for American Immigration Reform (FAIR).

Awww, it’s like a dagger in Barry’s heart to have to protect the taxpayers from paying illegals. I hope he doesn’t have any more numbingly difficult decisions to make in the near future, like following the Constitution.

ALL EMPLOYERS, including OUR FEDERAL GOVERNMENT (not just their contractors (as many States have also stipulated), should be required to use E-Verify.

But gawd forbid such EFFECTIVE legislation should ever pass.

Zero’s playing both sides of the issue. The E-verify program runs out at the end of September unless re-authorized. Zero’s counting on his minions to let it die. He already killed the No-Match rule, now he’ll dismantle E-Verify, but when the election comes around he can claim that he supported it.

From todays NAFBPO report:

“The Mexican consulate in Chicago issues the most immigrant documents of all Mexican consulates worldwide. According to a press release by the consulate, 101,469 documents were issued in the first half of 2009, of which 50,552 were passports and 42,092 were “matriculas consulares” [identification cards issued to Mexican citizens abroad regardless of immigration status].”

E-Verify is a joke. It was set up to appease those of us who are sick and tired of illegal immigration, but does nothing to send the ones here back home without the employer running the risk of lawsuit for discrimination....

From the e-verify employer manual (pg. 6):

2.1 The Rules of Use

1. Employees must be newly hired with a completed Employment Eligibility Verification Form I-9 (referred to hereafter as Form I-9) before you can use E-Verify to initiate queries about the employees for your company.

2. Form I-9 requirements remain the same except that all “List B” identity documents must bear a photograph.

3. Employers must submit verification queries for newly hired employees no later than the 3rd business day after they start work for pay.

4. If you haven’t started a verification query by the third business day after the employee starts work for pay immediately start the verification process. If you also failed to complete the Form I-9, a new Form I-9 must be completed before the query process is started.

5. Employers may not verify newly hired employees selectively and must follow E-Verify procedures for all new hires while their company is participating in the program.

6. Employers may not request that the employee use certain documentation for Form I-9 or E-Verify purposes.

7. Employers may not use E-Verify to discriminate against any job applicant or new hire on the basis of his or her national origin, citizenship, or immigration status.

8. Employers may not use the system to pre-screen applicants for employment.

9. Employers may not go back to check employment eligibility for employees hired before their company signed the MOU with USCIS and SSA.

10. Employers must provide their employees with an opportunity to contest a Tentative Nonconfirmation (TNC).

11. Employers cannot take any adverse action against an employee based upon a TNC unless E-Verify issues a Final Nonconfirmation (FNC).

12. Employee must be allowed to continue to work during the verification process.

There is an easy way to implement this. Simply require business, state and federal agencies to withhold taxes at the highest rate (regardless of the W2), plus have the hiring agency pay into an escrow an additional 20% of base salary until such time as the the employee completes the e-verify system.

Once that is completed and the employee verified, the escrow is returned. If the employee is found to be an illegal alien, then not only is the escrow forfeit but an additional tax, equal to sum of all salaries paid to this individual is assessed.

Further, on finding a single incident of hiring an illegal alien, then the IRS audits the entire employee and contractor hiring practices for the previous three years. To look for any other illegal activity.

I predicted when they took e-verify out of Obama’s “stimulus,” they wanted to save it as a bargaining chip when they bring back amnesty. Of course I don’t trust them (either party) to use e-verify in good faith in enforcing immigration, no matter what they promise.

Cornyn was booed in the Austin, TX Tea Party on July 4, I believe in part because of the noises he has been making about “immigration reform.”

Four Victories in the Senate!!!
In last week’s newsletter, I wrote about how quiet things were with Congress out of town for the Fourth of July recess. But how things can change in just one week! Four immigration-reduction amendments to the Homeland Security spending bill were offered on the floor of the Senate this week, and thanks to you, we won all four!
Things were a bit crazy at NumbersUSA’s two Washington-area offices on Wednesday and Thursday. The tech staff was hard at work making sure our website could handle our second busiest day of the year in terms of visitors, while the web content team in the Arlington, Va. office kept up-to-the-minute information on our front page to keep you informed to everything that was happening.
