Family members have described rape suspect Felix E. Montoya as a short-tempered man prone to violent outbursts, new information that justified increasing his bail to $500,000, a prosecutor said Tuesday.
Magisterial District Judge Alyce Farrell granted a request for bail modification for Mr. Montoya, more than doubling the original amount of $200,000, after receiving details about the Taylor man's violent home life, First Assistant District Attorney Gene Talerico said.
While Mr. Montoya remains in the Lackawanna County Prison, the public has inundated the district attorney's office with gifts and offers of assistance for the 5-year-old girl he is accused of raping and trying to kill at her Taylor home.
"There is like a hole in everybody's heart," Mr. Talerico said of the outpouring of sympathy for the victim and her family.
Mr. Montoya, 40, of 270 Tamworth Drive, was arrested early Sunday by Taylor police after the 5-year-old's parents discovered the mostly unclothed man hiding under their daughter's bed.
The Times-Tribune does not identify victims of alleged sexual assaults.
In a written request to Judge Farrell on Monday afternoon to increase Mr. Montoya's bail, Mr. Talerico cited information developed from interviews with the suspect's wife and stepchildren that was not presented at his arraignment Sunday.
Mr. Montoya's stepson, Richard Nives, 19, reported his stepfather has "a violent temper manifesting itself in frequent outbursts within the home," Mr. Talerico told the judge. Many times - at least once a month - the outbursts resulted in physical assaults against Mr. Nives.
"Mr. Nives was comforted to know that the defendant would no longer reside in the family home because of his arrest," Mr. Talerico said.
Although Mr. Montoya apparently has only one previous arrest on his record, related to a domestic incident six years ago in Brooklyn, N.Y., his wife indicated that he "becomes violent and 'mean' when he drinks alcohol," the prosecutor told the judge.
He also told Judge Farrell that the wife, who was not identified by name, planned to move the family to an undisclosed location as a result of the criminal charges against Mr. Montoya.
Mr. Talerico said Tuesday prosecutors were concerned that, in the event Mr. Montoya was able to post the $200,000, he would be returning "to a place where there were problems to begin with" - facts he said Judge Farrell needed to know.
"There are some significant concerns if he returns home," Mr. Talerico said. "That changes the equation."
A spokesman for U.S. Immigration and Customs Enforcement confirmed Tuesday that Mr. Montoya, a native of Colombia, is a legal resident of the United States. Police have said he is not an American citizen.
"ICE is aware of the charges against Mr. Montoya and has been in contact with the local authorities," said Mark Medvesky, spokesman for the agency's Philadelphia office.
Mr. Talerico said the district attorney's office has fielded an unimaginable number of phone calls from people asking how they can help the victim and her family.
Others have stopped by the office with gifts for the girl - everything from stuffed animals to clothing to baskets donated by businesses at the Mall at Steamtown.
"It's not a put-a-little-something-together," Mr. Talerico said. "It's incredible, over and beyond."

Clothes and stuffed animals- pitiful.. Certificates for years of psychiatric therapy would be more appropriate.
The parents found a half naked man under their 5 year old daughters’ bed? AND CALLED THE COPS?????? Must have been liberals. Otherwise the headline would likely read differently. “Man still missing after month-long search, family not concerned.”
Bail would have never been a consideration...
I don’t understand why the father didn’t shoot him and then call the cops. It would certainly be justified.
